Common use of Notice in Writing Clause in Contracts

Notice in Writing. A notice, consent or other communication given by one Party to the other under this Agreement must be: (a) in writing, signed (physically or by electronic signature) by or on behalf of the Party giving it; (b) addressed to the recipient Party and marked to the attention of the person (or control room) specified for the recipient Party in Annexure 1 or as otherwise notified, in writing, to the other Party from time to time; and (c) either: (i) hand delivered to a representative of the recipient at the recipient Party’s address; (ii) sent by pre-paid mail or delivered to the recipient Party’s address; or (iii) sent by email to that Party’s email address, as specified in Annexure 1 or as otherwise notified, in writing, to the other Party from time to time.
