Common use of Notice of Appeal Clause in Contracts

Notice of Appeal. Within ten (10) calendar days of receipt by a firefighter of notification of punitive action as set forth above, the firefighter shall notify the Fire Chief in writing of the firefighter’s intent to appeal the punitive action. The notice of appeal shall specify the action being appealed and the substantive and procedural grounds for the appeal.

Within ten fifteen (1015) calendar days of receipt by a firefighter of notification of punitive action as set forth above, the firefighter shall notify the Fire Chief in writing of the firefighter’s intent to appeal the punitive action. Within ten seven (107) calendar days of receipt by a firefighter of notification of a punitive action as set forth aboveaction, the firefighter shall notify the Fire Chief in writing of the firefighter’s intent that he/she intends to appeal the punitive action. The notice of appeal shall specify the action being appealed and the substantive and procedural grounds for the appeal. Nothing in this section shall limit the right of the Department to institute disciplinary action, notwithstanding that an appeal may be pending.
