Common use of Notice of Completion; Copy of Record Set of Plans Clause in Contracts

Notice of Completion; Copy of Record Set of Plans. Within twenty (20) days after completion of construction of the Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty (120) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Within twenty ten (2010) days after completion of construction of the Tenant Improvements, Tenant shall prepare a Notice of Completion, which Landlord shall execute if factually correct, and Tenant shall cause a such Notice of Completion to be recorded in the appropriate office of the Recorder of the county in which the Building is located recorder in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Construction Drawings as necessary to reflect all changes made to the Approved Working Construction Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built updated drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies CD-ROMs of such record set of drawings updated Approved Construction Drawings, in CAD format, within one hundred twenty thirty (12030) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

At the conclusion of construction, (i) Tenant shall cause the Architect and Tenant's Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the applicable 6310 Expansion Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the applicable 6310 Expansion Premises.

If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of “as-built built” drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord a digital CAD set and two (2) sets of copies of such record set of drawings within one hundred twenty sixty (12060) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) business days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) electronic CAD’s and two (2) full-size sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Within twenty ten (2010) days after completion of construction Substantial Completion of any relevant Phase of the Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings in CAD format within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, fixtures and systems in the PremisesPremises or elsewhere in the Building to the extent not previously provided.

Within twenty ten (2010) days after completion of construction of the Lessee Improvements, Tenant Lessee shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located County of Santa Xxxxx in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord Lessor upon such recordation. If Tenant Lessee fails to do so, Landlord Lessor may execute and file the same on behalf of Lessee as TenantLessee’s agent for such purpose, at TenantLessee’s sole cost and expense. At the conclusion of construction, (i) Tenant Lessee shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar “as-built built” drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord Lessor two (2) printed sets of copies and one (1) electronic set in CAD format on CD of such record set of drawings within one hundred twenty sixty (12060) days following issuance of a certificate final permit accepting the work of occupancy for the PremisesLessee Improvements or similar final sign-off, and (ii) Tenant Lessee shall deliver to Landlord Lessor a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Within twenty ten (2010) days after completion of construction of the Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located County of Sonoma in accordance with Section section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. At the conclusion of construction, Tenant shall: (i) Tenant shall cause the Tenant's Architect and Contractor contractor to do the following: (A) to update the Approved Working Tenant's Construction Drawings as necessary to reflect all changes made to the Approved Tenant's Working Drawings during the course of constructionconstruction so as to create a "record set" of plans for the Premises, (B) to certify to the best of their knowledge that the “record-set” set of as-built drawings are true and correct, which certification certifications shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, ; and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, guarantees and operating manuals and information relating to the improvements, equipment, equipment and systems in the Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty fifteen (2015) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty fifteen (2015) business days after completion of construction of the Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statuteapplicable laws, and shall furnish a copy thereof to Landlord FLUC upon such recordation. If Tenant fails to do so, Landlord FLUC may execute and file the same as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Plaza Lease, and (C) to deliver to Landlord FLUC two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Suite 100 Expansion Premises, and (ii) Tenant shall deliver to Landlord FLUC a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Suite 100 Expansion Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two four (24) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.and

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord Xxxxxxxx may execute and file the same on behalf of Xxxxxx as Tenant’s Xxxxxx's agent for such purpose, at Tenant’s Xxxxxx's sole cost and expense. At the conclusion of construction, construction Tenant shall (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (Bii) to certify to the best of their Tenant's knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (Ciii) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (iiiv) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after completion of construction of the Leasehold Improvements, Tenant Lessee shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statuteapplicable laws, and shall furnish a copy thereof to Landlord Lessor upon such recordation. If Tenant Lessee fails to do soso within two (2) days after notice from Lessor, Landlord Lessor may execute and file the same on behalf of Lessee as TenantLessee’s agent for such purpose, at TenantLessee’s sole cost and expense. At the conclusion of construction, (i) Tenant Lessee shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord Lessor two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant Lessee shall deliver to Landlord Lessor a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises, and (iii) Lessee shall deliver to Lessor the original signed permit card, indicating final approval by all applicable departments.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after completion of construction of the Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two four (24) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of Mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Within twenty ten (2010) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent Agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

At the conclusion concllusion of construction, (i9i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) as necessary to certify reflect all changes made to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two three (23) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.. At least one (1) of the three (3) sets of drawings shall be in the form of mylar reproducibles. SECTION 5

Within twenty ten (2010) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this LeaseAmendment , and (C) to deliver to Landlord two four (24) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the PremisesExpansion Premises , and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Expansion Premises.. SECTION 5

Notice of Completion; Copy of Record Set of Plans. Within twenty fifteen (2015) days after completion of construction of the ImprovementsTenant Improvements as evidenced by final permit signoff from the City, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (iA) Tenant shall cause the Tenant’s Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all material changes made to the Approved Working Drawings during the course of construction, (B) to Tenant or Tenant’s Architect shall certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) Tenant shall cause the Tenant Architect to deliver to Landlord two (2) sets of copies of such record set of drawings electronically in both CAD and .pdf formats (with hand-marked construction changes on the .pdf version provided such marked changes are legible and such changes are minor in nature; any material changes shall be fully incorporated in both the .pdf and CAD formats) within one hundred twenty thirty (12030) days following issuance completion of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the PremisesImprovements.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after completion of construction of the Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statuteapplicable laws, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do soso within two (2) days after notice from Landlord, Landlord may execute and file the same on behalf of Tenant as TenantXxxxxx’s agent for such purpose, at TenantXxxxxx’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the 3560 Xxxxxxx Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the 3560 Xxxxxxx Premises, and (iii) Tenant shall deliver to Landlord the original signed permit card, indicating final approval by all applicable departments.

Notice of Completion; Copy of Record Set of Plans. Within twenty fifteen (2015) days after completion of construction of the Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building Project is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.. SECTION 5

Notice of Completion; Copy of Record Set of Plans. Within twenty fifteen (2015) days after completion of construction of the ImprovementsImprovements for each Phase, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the applicable portion of the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after completion of construction of the Lessee Improvements, Tenant Lessee shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located County of San Mateo in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord Lessor upon such recordation. If Tenant Lessee fails to do so, Landlord Lessor may execute and file the same on behalf of Lessee as TenantLessee’s agent for such purpose, at TenantLessee’s sole cost and expense. At the conclusion of construction, (i) Tenant Lessee shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of mylar “as-built built” drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord Lessor two (2) sets of copies of such record set of drawings within one hundred twenty sixty (12060) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant Lessee shall deliver to Landlord Lessor a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof shall be furnished to Landlord upon such recordation. If Tenant fails to do soa Notice of Completion is not so recorded, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of constructionconstruction of the Tenant Improvements, Tenant shall (i) Tenant shall cause the Architect to prepare final as-built drawings for the Premises, (B) cause the Architect and the Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver cause the delivery to Landlord two of four (24) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy all governmental permits and approvals required for the Premisescompletion of the Tenant Improvements and occupancy of the Premises affected thereby, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.Tenant Improvements. SECTION 5

At the conclusion of construction, (i) Tenant shall cause the Architect and the Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to Tenant to the best of their knowledge that the “"record-set” " of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

At the conclusion of construction, (i) Landlord and Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord and Tenant two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant Landlord shall deliver to Landlord Tenant a copy copy, bound in a binder (with an index), of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor to (Ai) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (Bii) to certify to the best of their knowledge that the “"record-set” " of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (Ciii) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises. At the conclusion of construction, and (ii) Tenant shall also deliver to Landlord a copy of all warranties, guarantiesguarantees, and operating manuals and information relating to the improvementsTenant Improvements, equipment, and systems in the Premises.

At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty (120) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.. At the conclusion of constructionconstruction of the Tenant Improvements, Tenant shall (i) Tenant shall cause the Architect to prepare final as-built drawings for the Premises, (B) cause the Architect and the Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver cause the delivery to Landlord two of four (24) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy all governmental permits and approvals required for the Premisescompletion of the Tenant Improvements and occupancy of the Premises affected thereby, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.Tenant Improvements. (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of mylar as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the PremisesBuilding, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Leased Premises.

Within twenty (20) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Tenant’s Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Notice of Completion; Copy of Record Set of Plans. Within twenty ten (2010) days after the completion of construction of the tenant Improvements, . Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located County of San Mateo in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord landlord upon such recordation. If Tenant fails to do so, . Landlord may execute and file the same on behalf of Tenant as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. Within twenty fifteen (2015) days after completion of construction of the Tenant Improvements, Tenant shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (C) to deliver to Landlord two (2) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the TENANT WORK Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.

Within twenty ten (2010) days after completion of construction of the Tenant Improvements, Tenant Lessee shall cause a Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 8182 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord Lessor upon such recordation. If Tenant Xxxxxx fails to do so, Landlord Lessor may execute and file the same on behalf of Xxxxxx as TenantXxxxxx’s agent for such purpose, at TenantXxxxxx’s sole cost and expense, subject to any then remaining portion of the Tenant Improvement Allowance. At the conclusion of construction, (i) Tenant Lessee shall cause the Architect and Contractor (A) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (B) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this the Lease, and (C) to deliver to Landlord two Lessor four (24) sets of copies of such record set of drawings within one hundred twenty ninety (12090) days following issuance of a certificate of occupancy for the Expansion Premises, and (ii) Tenant Lessee shall deliver to Landlord Lessor a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.
