Notice of Completion; Copy of Record Set of Plans. Within ten (10) days after completion of construction of the Tenant Improvements, Tenant shall cause a valid Notice of Completion to be recorded in the office of the Recorder of the county in which the Building is located in accordance with Section 3093 of the Civil Code of the State of California or any successor statute, and shall furnish a copy thereof to Landlord upon such recordation. If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s agent for such purpose, at Tenant’s sole cost and expense. If Tenant Reliant fails to do so, Landlord Mercury may execute and file the same on behalf of Tenant Reliant as TenantReliant’s agent for such purpose, at TenantReliant’s sole cost and expense. At the conclusion of construction, (i) Tenant Reliant shall cause the Architect Design Professionals and Contractor Contractors (xa) to update the Approved Working Drawings Construction Documents as necessary to reflect all changes made to the Approved Working Drawings Construction Documents during the course of construction, (yB) to certify to the best of their knowledge that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of the Leasethis Sub-Sublease, and (zC) to deliver to Landlord Mercury two (2) sets of copies of such record set of drawings and one (including one set 1) additional electronic copy (in an AutoCAD Computer Assisted Drafting and Design System format.dwg format in accordance with AIA layering standards) within ninety (90) days following issuance of a certificate of occupancy for the Subleased Premises, and (ii) Tenant Reliant shall deliver to Landlord Mercury a copy of all warranties, guaranties, and operating manuals and information relating to the improvementsImprovements, equipment, and systems in the Subleased Premises.

If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. At the conclusion of constructionconstruction of the Tenant Improvements, (i) Tenant shall cause the Architect and TI Contractor (xA) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (yB) to certify to the best of their knowledge that the “"record-set” " of as-built drawings are true and correct, which certification shall survive the expiration or termination of the this Lease, and (zC) to deliver to Landlord two (2) sets of copies of such record set of drawings (including one set in an AutoCAD Computer Assisted Drafting and Design System format) within ninety (90) days following issuance of a certificate of occupancy signed off job card or "finaled" Permits for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises, and (D) copies of signed-off Permits, certificates of occupancy for the Premises, if any, and a stamped set of final approved plans evidencing governmental approval of the completion of the Tenant Improvements.

If Tenant fails to do so, Landlord may execute and file the same on behalf of Tenant as Tenant’s 's agent for such purpose, at Tenant’s 's sole cost and expense. At the conclusion of construction, (i) Tenant shall cause (A) the Architect and Contractor (x) to update the Approved Working Drawings as necessary to reflect all changes made to the Approved Working Drawings during the course of construction, (yB) the Contractor to certify certify, to the best of their knowledge its knowledge, that the “record-set” of as-built drawings are true and correct, which certification shall survive the expiration or termination of this Lease, (C) the Architect to certify, to the best of its knowledge, that the record drawings are true and correct, which certification shall survive the expiration or termination of this Lease, and (zD) the Architect and Contractor to deliver to Landlord two (2) sets of copies of such record set of drawings (including one set in an AutoCAD Computer Assisted Drafting and Design System format) as-built drawings, respectively, within ninety (90) days following issuance of a certificate of occupancy for the Premises, and (ii) Tenant shall deliver to Landlord a copy of all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises.
