Notice of Termination by Council. In order to terminate the employment of an employee, ICC shall give the following notice: Period of Continuous Service Period of Notice 1 year or less 1 week 1 year and up to the completion of 3 years 2 weeks 3 years and up to the completion of 5 years 3 weeks 5 years and over 4 weeks In addition to the notice above, employees over forty-five (45) years of age at the time of giving notice and with not less than two (2) years continuous service, shall be entitled to one (1) additional weeks notice. Payment in lieu of notice shall be made if the appropriate notice is not given, provided that employment may be terminated by part of the period of notice specified and part payment in lieu thereof. In calculating any payment in lieu of notice the ordinary time rate of pay for the employee concerned shall be used. Provided that an employee who has been engaged for a specific period of time or for a specific task or tasks, shall be given one (1) weeks notice, or in lieu of such notice, one week’s wages shall be paid or deducted. Casual employees may be dismissed without notice. Employees who engage in serious misconduct may be dismissed without notice.
