Common use of Notice of Violation Clause in Contracts

Notice of Violation. On September 8, 2020, Ecological served Geoglobal, Home Depot X.XX., Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal and such public enforcers with notice that Geoglobal was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINP. To the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8January 24, 2020, Ecological served GeoglobalPeace Out, Home Depot X.XX.Sephora USA, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Peace Out and such public enforcers with notice that Geoglobal Peace Out was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8March 30, 20202021, Ecological served GeoglobalRiviana, Home Depot X.XX., Inc.Ralphs Grocery Company, and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Riviana and such public enforcers with notice that Geoglobal Riviana was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPlead. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8October 25, 20202022, Ecological served Geoglobal, Home Depot X.XX., Inc., Xxxxxx and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Xxxxxx and such public enforcers with notice that Geoglobal Xxxxxx was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8June 15, 2020, Ecological served GeoglobalBest Choice, Home Depot X.XX.Xxxxxx.xxx, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Best Choice and such public enforcers with notice that Geoglobal Best Choice was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8January 15, 2020, Ecological served GeoglobalBendon, Home Depot X.XX., Inc.Grocery Outlet Holding Corp., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Bendon and such public enforcers with notice that Geoglobal Bendon was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8June 14, 20202018, Ecological served GeoglobalWal-Mart Stores East, Home Depot X.XX., Inc.L.P., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Towa and such public enforcers with notice that Geoglobal Towa was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8March 22, 20202018, Ecological served GeoglobalCoverite, Home Depot X.XX., Inc.The Pep Boys Xxxxx Xxx & Xxxx of California, and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Coverite and such public enforcers with notice that Geoglobal Coverite was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPlead. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8November 29, 20202021, Ecological served GeoglobalBagel, Home Depot X.XX.Sprouts Farmers Market, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Bagel and such public enforcers with notice that Geoglobal Xxxxx was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPLead. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

On September 8October 2, 2020, Ecological served GeoglobalOrbit, Xxxx’x Home Depot X.XX.Centers, Inc.LLC, and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Orbit and such public enforcers with notice that Geoglobal Orbit was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

On September 8January 14, 20202019, Ecological served GeoglobalCudlie, Home Depot X.XX.Xxxx Stores, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Cudlie and such public enforcers with notice that Geoglobal Cudlie was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

On September 8March 25, 20202021, Ecological served GeoglobalDSD, Home Depot X.XX.Winco Foods, Inc.LLC, and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal DSD and such public enforcers with notice that Geoglobal DSD was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPlead. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8December 14, 2020, Ecological served GeoglobalNavitas, Home Depot X.XX.Whole Foods Market California, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California California, with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Navitas and such public enforcers with notice that Geoglobal Navitas was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPLead. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8December 9, 2020, Ecological served GeoglobalCedars, Home Depot X.XX.Sprouts Farmers Market, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Cedars and such public enforcers with notice that Geoglobal Cedars was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPLead. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8December 10, 20202018, Ecological served Geoglobal, Home Depot X.XX., Inc., Xxxxxxx and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Xxxxxxx and such public enforcers with notice that Geoglobal Xxxxxxx was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8October 16, 2020, Ecological served GeoglobalTri-Union, Home Depot X.XX., Inc.Stater Bros. Markets, and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Tri-Union and such public enforcers with notice that Geoglobal Tri-Union was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPLead. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8October 22, 2020, Ecological served GeoglobalImpresa, Home Depot X.XX.Xxxxxx.xxx, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Impresa and such public enforcers with notice that Geoglobal Impresa was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8October 19, 20202021, Ecological served Geoglobal, Home Depot X.XX., Inc.WS Trading, and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal 5-Below and such public enforcers with notice that Geoglobal 5-Below was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice. 5-Below tendered the Notice to WS Trading.

Notice of Violation. On September 8October 11, 20202019, Ecological served GeoglobalForever Link, Home Depot X.XX.Xxxx Stores, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Forever Link and such public enforcers with notice that Geoglobal Forever Link was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8January 19, 2020, 2017 Ecological served GeoglobalWesco, Home Depot X.XX.Xxx.xxx, Inc., and the requisite all public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "“60-Day Notice of Violation" ” ("“Notice"”) that provided Geoglobal Wesco and such public enforcers with notice that Geoglobal alleged that Wesco was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPlead. To the best of the Parties' ’ knowledge, no public enforcer has commenced or is diligently prosecuting prosecuted the allegations set forth in the Notice.

Notice of Violation. On September 8February 18, 2020, Ecological served GeoglobalXxxxx, Home Depot X.XX.Recreational Equipment, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents a document entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Xxxxx and such public enforcers with notice that Geoglobal Xxxxx was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8March 2, 2020, Ecological served GeoglobalCargo, Home Depot X.XX.Xxxxxx.xxx, Inc.Inc. (“Amazon”), and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Cargo and such public enforcers with notice that Geoglobal Cargo was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the best of the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.

Notice of Violation. On September 8June 12, 2020, Ecological served GeoglobalPremium, Home Depot X.XX.Xxxxxx.xxx, Inc., and the requisite public enforcement agencies eligible to initiate Proposition 65 actions on behalf of the People of the State of California with documents entitled "60-Day Notice of Violation" ("Notice") that provided Geoglobal Premium and such public enforcers with notice that Geoglobal Premium was allegedly in violation of California Health & Safety Code section 25249.6 for failing to warn consumers and customers that the Products exposed users in California to DINPDEHP. To the Parties' knowledge, no public enforcer has commenced or is diligently prosecuting the allegations set forth in the Notice.
