Common use of NOTICE TO PROCEED WITH FABRICATION AND INSTALLATION Clause in Contracts

NOTICE TO PROCEED WITH FABRICATION AND INSTALLATION. City, in City’s sole discretion, xxx decide to proceed or not to proceed with the Artwork. If City decides to proceed and all approvals are secured, City's Public Art Program Officer will issue a written Notice to Proceed with Fabrication and Installation to the Artist. Artist shall not commence fabrication and installation of Artwork until Program Officer has issued such Notice. If Notice to Proceed with Fabrication and Installation is issued such that City and Artist agrees that there is reason to anticipate a delay in the mutually agreed schedule of performance through no fault of Artist, then City and Artist shall identify the revised Schedule of Performance in writing on the Notice to Proceed with Fabrication and Installation or on such other mutually executed amendment to the Schedule of Performance.

Project Artist shall not commence fabrication and installation of Artwork until City’s Public Art Program Officer has issued such Notice. If Notice to Proceed with Fabrication and Installation is issued such that City and Artist agrees agree that there is reason to anticipate a delay in the mutually agreed schedule of performance performance, and, through no fault of Artist, there is a delay, then City and Artist shall identify the revised Schedule of Performance in writing on either of the Notice Notices to Proceed with Fabrication and Installation or on such other a mutually executed amendment to the Schedule of Performance.
