Notice to Surety; Consent. 10.5.1 The Contractor shall notify and obtain the consent and approval of the Contractor’s surety with reference to all Change Orders if such notice, consent or approval are required by the Contractor’s surety or by law. The Contractor’s execution of the Change Order shall constitute the Contractor’s warranty to the Owner that the surety has been notified of and consents to, such Change Order and the surety shall be conclusively deemed to have been notified of such Change Order and to have expressly consented thereto.
