Common use of Notification of Action Clause in Contracts

Notification of Action. The Employer shall: (i) within ten (10) working days of such meeting advise the employee and the Union, in writing, of its decision, and shall include the reasons for such decision if discipline is to be imposed; (ii) where the discharge or the suspension without pay of the employee is being considered, delay the imposition of discipline for five (5) working days on request from the Union and/or the employee.

At the discharge or the suspension without pay request of the employee is being consideredor the Union, the designate from the Employer's representatives on the Labour/Management Committee shall delay the imposition of discipline for five (5) working days on request from where the Union and/or the employeediscipline being considered includes either discharge or a suspension without pay.
