Common use of Notification of Variance or Deficiency Clause in Contracts

Notification of Variance or Deficiency. It is the CMARE’s responsibility to assist the Design Professional in ascertaining that, in the CMARE’s professional opinion, the Construction Documents are in accordance with applicable laws, statutes, ordinances, building codes, rules and regulations. If the CMARE recognizes that portions of the Construction Documents are at variance with applicable laws, statutes, ordinances, building codes, rules and regulations, it will promptly notify the Design Professional and County in writing, describing the apparent variance or deficiency. However, the Design Professional is ultimately responsible for the compliance with those laws, statutes, ordinances, building codes, rules and regulations.
