Pre-Construction Services. Contractor shall perform the following pre-construction services to be completed by:
Pre-Construction Services. Upon the later of the execution of this Agreement and issuance of a written “Notice to Proceed (Pre-Construction Phase)” by Owner (the “Pre- Construction Phase Commencement Date”), Construction Manager shall commence performance of Pre-Construction Services. Any Work performed by Construction Manager prior to such date shall be at the sole risk and expense of Construction Manager. The timely completion of the pre-construction phase is critical to the timely completion of the construction phase and, therefore, completion of the entire Project. Accordingly, Construction Manager agrees to provide the Pre-Construction Services in accordance with the schedule approved by Owner in writing. The “Pre-Construction Services” include the following: 3.4.1 Construction Manager shall provide a preliminary evaluation of Owner’s program, schedule and construction budget requirements, each in terms of the other. Construction Manager shall advise Owner on proposed site use and improvements, selection of materials, and building systems and equipment.
Pre-Construction Services. A. The CM/GC agrees to perform the CM/GC pre-construction phase services and to perform its obligations and to comply with the other terms and conditions applicable to CM/GC under the CM/GC Pre-Construction Phase Services Contract Documents. The CITY agrees to perform its obligations and to comply with the other terms and conditions applicable to CITY under the CM/GC Pre-Construction Services Contract Documents. B. This is a contract for CM/GC pre-construction phase services only. CM/GC agrees to perform all CM/GC pre-construction phase services specified in this Agreement, to be performed during the pre-construction phase (consisting of the traditional Program Development sub-phase, Schematic Design sub-phase, Design Development sub-phase and Construction Documents sub-phase of design development). C. If and when CITY and CM/GC agree to a Guaranteed Maximum Price and certain other matters concerning the Construction Phase and execute the CM/GC Construction Contract, then and only then will there be a contract for construction services and for the CM/GC to do the Construction Work. Until then, CITY has no obligation to obtain the Construction Work from the CM/GC, and the CM/GC has no obligation to perform the Construction Work. The CITY reserves the right to issue a new RFQ for pre-construction phase services, to bid the Construction Work, or select a contractor for Construction work in any manner allowed by CITY ordinance. D. The CM/GC, to further the interests of the CITY, will perform the services required by, and in accordance with this Agreement, to the satisfaction of the Contract Administrator, exercising the degree of care, skill and judgment a professional construction manager performing similar services in Ogden City, Utah would exercise at such time, under similar conditions. The services being provided under this Agreement will not alter any real property owned by the CITY. The CITY agrees to perform its obligations and to comply with the other terms and conditions applicable to CITY under this Agreement.
Pre-Construction Services. Contractor shall provide pre-construction services to Owner as follows: 5.1.1 Contractor shall work with the Architect and Owner to review schematic design, design development and construction drawings for the Project, to evaluate proposed systems and materials, to make recommendations regarding systems and materials which may improve cost effectiveness of the Project or accelerate the schedule. 5.1.2 Contractor shall provide a proposed Project Schedule based upon the schematic design. Project Schedule should show substantial completion dates for the Project no later than set forth on Exhibit 5. Project schedule should include all activities and milestones to take the Project from schematic design to occupancy. Scheduled activities will include meetings, design and construction document time frames, procurement delivery dates, permitting, approvals of authorities, coordination time frames and construction dates. 5.1.3 Contractor shall provide budget development and cost evaluation consisting of estimating, value analysis and life cycle analysis. Estimates shall be prepared at schematic design and design development. Interim estimates shall be prepared any time there is a significant design change. Proposed systems shall be evaluated for first cost, constructability, annual maintenance costs, annual utility costs, life expectancy and schedule impact.

The phasing of, and schedule for, design for this Project is set forth on Exhibit B. 3.4.2 Submit for Owner review within thirty (30) calendar days of the Owner’s execution of this Agreement: (i) Project reporting procedures; (ii) Quality Control and Testing Program; and (iii) Safety Program. 3.4.3 The Design Professional is required, in accordance with schedule requirements, to provide design concepts, narratives, and drawings. At each phase of design, in keeping with the Owner’s goals and the Facilities Program for the Project, the Construction Manager shall familiarize itself with these design documents and, in accordance with the Schedule on Exhibit B, provide the Owner and Design Professional with a report detailing construction issues and concerns relating to the design, with detail appropriate to the phase of design. Without limitation of the foregoing, each construction report shall: (i) include an estimate of overall construction cost, with Construction Manager’s contingency associated with the Cost of the Work at no greater percentages than the percentages set forth on Exhibit E, including a comparison of the estimate to Owner’s budget for construction; (ii) identify conceptual decisions necessary to prepare accurate cost reports with the fewest assumptions, qualifications and exclusions; (iii) include an analysis and evaluation of jobsite management, site logistics, and schedule considerations; (iv) include an analysis and evaluation of the constructability of the design concepts, narratives, or drawings; (v) include an analysis and evaluation of the design concepts, narratives, or drawings in regard to the completeness of intended bid categories, conflicts or overlaps in the divisions of the Work, design details affecting construction including, without limitation, unusual or custom materials, value analysis, identification of long-lead materials affecting the Construction Schedule, availability of labor, and other factors affecting construction and, in the report provided during the Construction Documents Phase, suggestions for alternatives for matters which may delay the construction schedule; (vi) address problems, conflicts, defects or...
Pre-Construction Services. A. Initiate a collaborative document management system for the design and construction teams. B. Work with Owner, Architect/Engineer (A/E) and Construction Manager as Constructor (CMc) to develop project development schedule. C. Work with Owner, A/E and CMc to develop overall pro-forma budget including breakout of construction and non-construction costs (soft costs including all misc. fees). D. Work with A/E and CMc throughout schematic design phase to validate or revise the project schedule and budget. E. Attend and participate in periodic design meetings. F. Review and comment on plans and specifications as they are developed. G. Recommend design and construction alternatives. L. Communicate critical information to the appropriate City staff personnel and receive feedback for the design team. Communicate the response back to the project teams. M. Facilitate coordination between Redevelopment Commission, Department of Development, Parks Department, Mayor, other City Staff, Contractors and Engineer. N. Provide weekly updates to the City representatives on pending action items. O. Work with the City’s communications staff on important information updates to the general public. P. Facilitate procurement of services outside of A/E and CMc if required. Q. Other services as needed.

Pre-Construction Services. Although CM@Risk has performed Pre-Construction Services pursuant to a separate Agreement between City and CM@Risk, the completion, quality and accuracy of those services and the deliverables provided by City thereunder directly impact CM@Risk’s performance of its obligations under this Agreement. Therefore, all of CM@Risk’s obligations, duties, and warranties in relation to Pre-Construction Services and deliverables survive completion of the Pre-Construction Services Agreement and are incorporated herein. Any breach of any of CM@Risk’s duties, obligations, or warranties under the Pre-Construction Services Agreement will likewise be considered a breach of this Agreement.
