A copy of the Agreement and Declaration of Trust of the Trust is on file with the Secretary of The Commonwealth of Massachusetts, and notice is hereby given that this agreement is executed on behalf of the Trustees as Trustees of the Trust and not individually, and that the obligations of this agreement are not binding upon any of the Trustees or shareholders individually, but are binding only upon the assets and property of the relevant series of the of the Trust.
Obligation of the Trust. This agreement is executed by an officer of the Trust on the Trust’s behalf and not individually. The obligations of this agreement with respect to the New Fund are binding only upon the New Fund’s assets and property and not upon the Trust’s trustees, officers or shareholders individually. The Trust's Amended and Restated Agreement and Declaration of Trust, as amended, is on file with the Secretary of the State of Delaware and notice is hereby given that this Agreement is made and executed on behalf of the Trust, and not by the Trustees or officers of the Trust individually, and the obligations of or arising out of this Agreement are not binding upon the Trustees, officers or shareholders of the Trust individually but are binding only upon the assets and property of the Trust.
