Obligation on disclosure. Where a party discloses Confidential Information of the other party to another person: (a) pursuant to clauses 20.4(a), (b) or (e), the disclosing party must: (i) notify the receiving person that the information is Confidential Information; and (ii) not provide the information unless the receiving person agrees to keep the information confidential, including in the case of Commonwealth’ Confidential Information, the receiving person giving the Commonwealth a legally binding undertaking to that effect in the form approved by the Commonwealth; or (b) pursuant to clauses 20.4(c), (d), (f) and (h), the disclosing party must notify the receiving party that the information is Confidential Information of the other party.
