CIRCUMSTANCES BEYOND CONTROL. Xxxxxx shall not be liable under this Agreement in any case where Xxxxxx is prevented from carrying out its obligations under this Agreement by circumstances beyond its control. Xxxxxx shall not be liable for the cost of any repairs where approval for such repairs has not been given by the Warranty Administrator of Xxxxxx prior to commencement.

CIRCUMSTANCES BEYOND CONTROL. Landlord shall not be liable for any failure of Maintenance Obligations or Service Obligations when such failure is caused by (i) strikes, lockouts or other labor disturbance or labor dispute of any character, (ii) governmental regulation, moratorium or other governmental action, (iii) inability despite the exercise of reasonable diligence to obtain electricity, water or fuel from the providers thereof, (iv) acts of God or (v) any other cause beyond Landlord's reasonable control.
CIRCUMSTANCES BEYOND CONTROL. 40.1 If the Contractor is prevented from performing its obligations under this Head Agreement due to circumstances beyond the Contractor’s reasonable control (for example acts of God, natural disasters, acts of war, riots and strikes outside that party’s organisation), the Contractor must give Notice of such circumstances to the Finance Representative (and provide a copy to any Agencies affected) as soon as possible, identifying the specific effect those circumstances will have on its performance of this Head Agreement. 40.2 The Contractor must make all reasonable efforts to minimise the effects on this Head Agreement of circumstances beyond the Contractor’s reasonable control. 40.3 If the Contractor is prevented from performing its obligations under this Head Agreement due to circumstances beyond the Contractor’s reasonable control, the Finance Representative may approve an extension of time for the Contractor to perform the affected obligations, provided that the Contractor has given the Finance Representative all information or evidence required to demonstrate that the Contractor's performance under this Head Agreement is affected and the Contractor has otherwise complied with this clause 40.
CIRCUMSTANCES BEYOND CONTROL. Whenever a vendor’s place of business, mode of delivery, or source of supply has been unduly impacted by abrupt changes in world markets or disrupted by acts of government, God, civic commotion, or war, it shall be the responsibility of the vendor to promptly advise the Contract Administrator, in writing, as to the extent of this disruption presented is commensurate with the conditions established herein. The Contract Administrator may elect to modify delivery/service, timelines, renegotiate the contract in whole or in part, or cancel any open orders in accordance with Special Conditions 5.0. The vendor will be given written notification of all decision made.

CIRCUMSTANCES BEYOND CONTROL. 24.1 A Party is excused from performing its obligations to the extent it is prevented by circumstances beyond its reasonable control (other than lack of funds for whatever reason), such as acts of God, natural disasters, acts of war, riots, and strikes outside that Party’s organisation. Where these circumstances arise, the affected Party will give notice of them to the other as soon as possible, identifying the effect they will have on its performance, and will make all reasonable efforts to minimise the effects. 24.2 If non-performance or diminished performance by the affected Party continues for a period which the other Party reasonably regards as commercially untenable, the other Party may terminate the Head Agreement. If the Head Agreement is terminated in these circumstances, each Party will bear its own costs and neither Party will incur further liability to the other. CIRCUMSTANCES BEYOND CONTROL. No party may be held responsible to the other party for any defect or delay in the execution of the program causes by circumstances beyond their control including, but not limited to, natural disasters, fires, work strikes, or any governmental measures, the latter including 20 intervention by the Quebec or Ontario Securities Commission.
