Common use of Obligation on disclosure Clause in Contracts

Obligation on disclosure. Where a party discloses Confidential Information of another party to another person, the disclosing party must notify the receiving person that the information is Confidential Information of the other party. Nothing in this Schedule operates to permit the Grant Recipients to provide confidential information of a third party or the Grant Recipients to the Trustee in breach of their obligations under clause 3.2 of the Agreement. The Trustee is not liable in respect of any disclosure of information provided in breach of that clause.
