Obligations during Construction, Commissioning and Operation. 5.3.1 The SPD will be responsible for the design, implementation, operation and maintenance of the project. The Solar Power Developer will Design, Engineer, Procure, Undertake Civil and Electrical work including Erection, Testing & Commissioning of the solar PV project and subsequently carry out the Operation and Comprehensive Maintenance (O&M) of the project for a period of 25 years in accordance with the provisions of the Request for Proposal [(RFP No. *** dated DD.MM.YYYY of Railways)] 5.3.2 The SPD will, within the time specified in the Schedule N, submit to Railways, detailed drawings and interconnection plan of the systems to be developed under the Project for approval to Railways. If Railways has any objection/ recommendation in the Drawings, Railways will communicate the same to SPD as per the timelines in the Schedule N. In case of objection/clarification, if any, the SPD shall submit its response to the objection/clarification as per timelines in Schedule N. 5.3.3 The SPD shall procure the solar panel and other equipments in line with the technical specification provided in Schedule C. 5.3.4 The SPD will be required to submit a monthly progress report to Railways beginning with signing of Agreement till the COD in such form and latest by the seventh (7th) day of the month to Railways. This shall be subsequently followed by a meeting to discuss the progress of the project on such date as intimated by the Railways. A Monthly Monitoring Group (MMG) with representation of at least one (1) member of the SPD and representative of PCEE/ZR of the Railways to be nominated by PCEE/ZR shall be formed for the project within fifteen (15) days of from the Effective Date. The group shall monitor the progress of the Projects on monthly basis. The responsibilities of MMG will be as mentioned in 4.1.2. 5.3.5 The SPD will notify Railways as per the timeline in Schedule N for commissioning of the system. 5.3.6 The SPD will bear all costs pertaining to the installation and Commissioning of the systems and these costs will not be recoverable in any form from Railways. 5.3.7 Subject to article 6, the SPD will be responsible for achieving the Commercial Operation of the Facility latest by the Scheduled COD. 5.3.8 The SPD will not undertake phased Commissioning. The entire Facility will be commissioned no later than the timelines in Schedule N. The Solar Power Developer will furnish to Railways, by way of a written notice, a proposed interconnection plan, if applicable, together with details of the Relevant Premises pertaining to each phase, and estimated time lines for the Commissioning of the phases as per timelines in Schedule N.
