Obligations of Respondent a. If this Compromise Agreement is executed within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $8,000, as full satisfaction of the civil penalty proposed in the Notice, within thirty (30) calendar days of the issuance of the Adopting Order. If this Compromise Agreement is executed between thirty-one (31) and sixty (60) calendar days after the date of the Notice, Respondent agrees to pay the sum of $16,000 as full satisfaction of the civil penalty proposed in the Notice, within thirty (30) calendar days of the issuance of the Adopting Order.
b. Within sixty (60) calendar days following the issuance of the Adopting Order, Respondent will, in accordance with 10 C.F.R. Part 429, certify all basic models of all covered products and covered equipment that Respondent manufactures and distributes in commerce in the United States.
Obligations of Respondent a. Respondent agrees to pay the sum of $17,175, as full satisfaction of the civil penalty proposed in the Notice, within thirty (30) calendar days of the issuance of an Adopting Order.
b. Respondent agrees to abide by the terms of the Notice of Noncompliance Determination, issued on August 28, 2017, captioned under case number 2017-SE- 47003.
Obligations of Respondent a. If this Compromise Agreement is executed within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $8,000, as full satisfaction of the civil penalty proposed in the Notice, within thirty (30) calendar days of the issuance of the Adopting Order.
b. Within sixty (60) calendar days following the issuance of the Adopting Order, Respondent will, in accordance with 10 C.F.R. Part 429, certify all basic models of all covered products and covered equipment that Respondent manufactures and distributes in commerce in the United States.
c. Respondent will, in accordance with 10 C.F.R. Part 429, certify all basic models of all covered products and covered equipment that Respondent manufactures and distributes in commerce in the United States annually, as required by DOE Rules.
Obligations of Respondent a. Respondent agrees to pay the sum of $8,000, as full satisfaction of the civil penalty proposed in the Notice, within thirty (30) days of the issuance of the Adopting Order.
b. Within sixty (60) calendar days following the issuance of the Adopting Order, Respondent will, in accordance with 10 C.F.R. § 429.12, certify all basic models of all covered products and equipment Respondent manufactures and distributes in commerce in the United States.
Obligations of Respondent. Respondent agrees to abide by the terms of the Notice of Noncompliance Determination, issued on October 1, 2015, captioned under case number 2015-SE-16010.
Obligations of Respondent a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021, Respondent agrees to pay the sum of $439,620 (four hundred and thirty-nine thousand, six hundred and twenty dollars) as full satisfaction of the civil penalty proposed in the Notices, within thirty (30) calendar days of the issuance of an Adopting Order.
b. Respondent agrees not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120C, and to abide by the terms of the Notices of Noncompliance Determination, issued on April 28, 2020, and captioned under case numbers 2018-SE-43029 and 2018-SE-43031.
Obligations of Respondent a. If Respondent executes this Compromise Agreement and returns it to DOE no later than May 25, 2017, Respondent agrees to pay the sum of $13,200, as full satisfaction of the civil penalty proposed in the Notice, within thirty (30) calendar days of the issuance of an Adopting Order.
b. Respondent agrees to abide by the terms of the Notice of Noncompliance Determination, issued on January 13, 2017, also captioned under case number 2016-SW-29007.
