OBLIGATIONS OF THE DELTA CONTROLS PARTNER. 6.1 While Delta Controls and the Delta Controls Partner agree that they will work together in good faith in the performance of this Agreement and in satisfying customers of the Products, the Delta Controls Partner acknowledges and agrees that notwithstanding any reference to “Delta Controls Partner” it is not at law Delta Controls’ partner and the Delta Controls Partner agrees not to represent itself as such or act as such. Further, the Delta Controls Partner will not act as an agent, employee, joint venturer or legal representative of Delta Controls for any purpose whatever, and will have no power or authority to incur or create any obligations or liability of any kind for, or on behalf of, Delta Controls. The Delta Controls Partner will conduct its business as an independent contractor, and all persons employed in the conduct of such business will be employees of the Delta Controls Partner and all costs and obligations incurred by reason of any such employment will be for the account and expense of the Delta Controls Partner.
