The University undertakes • to provide the Student with the education and learning support facilities and other services associated with the Study Program with reasonable care and skill, subject to this Agreement; • to use all reasonable means to deliver the Study Program in accordance with the description provided in the relevant curriculum; • to make available to the Student such learning support facilities, courses and other services in accordance with the curriculum as it considers appropriate and reserves the right to vary these offerings at any time, subject to the University’s reasonable discretion and adequate consideration of the justified interests of its students; • to enable the Student to attend all courses at the University required for graduation in the chosen course of study; • to provide an appropriate substitute in the case of cancelled courses; • to educate the Student in accordance with the current program’s Study and Examination Regulations with the most recent version being available on the University website (xxxxx://xxx.xxxxx.xx.xx/student-life/academic-services/rules-and-regulations), whereby any changes thereto shall be made only subject to the University’s reasonable discretion under adequate consideration of the justified interests of its students or if required to comply with applicable legal provisions; • to provide the infrastructure necessary for due and proper completion of the Study Program; • to issue a certificate confirming the time period and contents of the Study Program, as well as final grades, graduation diplomas and academic degrees to the Student upon fulfillment of the required conditions; • to do its outmost to consider proven specific needs of students (e.g., physical or psychological disability) within the scope of its possibilities. Obligations of the University. (a) organizes the doctoral studies;
(b) provides education services to the doctoral student through the doctoral schools;
(c) ensures proper organizational and technical conditions for study and research, allowing the doctoral student to use the infrastructure of the University for documentation and research purposes; provides a free email account for academic and administrative correspondence only, in accordance with the Operating Regulation of the University’s Data Communication Centre, in order to ensure an official communication medium;
(d) organizes the public defence of the doctoral thesis;
(e) ensures the confidentiality of the doctoral student’s personal information, in compliance with the law;
(f) provides, upon request, transcripts of records and documents that certify the status of doctoral student, in accordance with the legislation;
(g) monitors and evaluates the doctoral student’s activity through the Institute for Doctoral Studies, throughout the doctoral studies;
(h) encourages the publication of the doctoral student’s scientific reports in specialized journals;
(i) does not discriminate, with regard to the curricula, against any doctoral students admitted to certain types of funding;
(j) provides scholarship to the doctoral students who have been granted a scholarship, in the amount and on the day established by the institution offering the scholarship through Babeş-Bolyai University.

B. The University will provide basic utilities to each residence hall. The cost of these utilities is incorporated within the overall residence hall room fee. The University shall also provide maintenance service in the event of mechanical difficulties or interruptions to any utility service which is under control and/or ownership of the University; and promptly seek such service in the event such difficulties or interruptions arise in facilities or equipment serving the University but not under University control. There will be no adjustment of housing fees because of the University’s inability to restore service for a reasonable period of time.
C. The University shall, within a reasonable time, exercise care to correct unsafe conditions in and maintain the residence halls. The student may request correction of such conditions through the hall staff or by contacting University Housing. The University is not responsible for the continuation of food, mail, custodial, heating, maintenance, or security service at normal levels in the event of a natural disaster, power/water/sewer interruptions, or in the event of other causal events beyond the control or reasonable anticipation of the University.
D. The University is not responsible for construction noise or disruptions associated with construction sites adjacent to the residence halls.
Obligations of the University. (1) The University commits itself to implementing the curriculum as agreed upon and authorized by the AQ Austria. It expressly reserves the right to amend the curriculum in the event that adjustments to national or EU legislation or changes in academic staff become necessary, which shall not be detrimental to the achievement of the projected academic goal in any way.
(2) In the event the University is forced, for whatever reasons, to discontinue the programme of study, it is obligated to guarantee that all examinations taken and skills acquired by the Student up to that point shall be credited in accordance with the European Credit Transfer System (ECTS).

6. Admit the Learner to the University to study in the study programme as specified in the Special Part of the Agreement or to study single subjects (modules), to take examinations (or tests resulting in pass/fail evaluation) of single subjects (modules).
7. Provide to the Student access to education in a selected study field as indicated in the study programme specified in the Special Part of the Agreement; the study programme shall comply with the content, nature and practical application possibilities of the study field.
8. Ensure the high quality of the delivery of the selected approved study programme or of single study subjects (modules).
9. To a Learner who has fully completed the study programme:
9.1. confer on the Student a qualification degree and/or professional qualification;
9.2. issue to the Student a University diploma certifying the acquired qualification degree and/or professional qualification and a diploma supplement certifying the assessment of the subjects;
9.3. issue to the Unclassified Student a certificate specifying the competences acquired by the Unclassified Student.
10. Pay grants to the Student as stipulated in the University Procedure for Student Grants.
11. Upon a request by the Learner, who has failed to complete the study programme, issue a transcript of academic record specifying the assessment of the completed study subjects (modules).
12. Ensure that legal acts adopted by the University be posted on the University website xxx.xx.

The University undertakes ▪ to provide the Student with the education and learning support facilities and other services associated with the Study Program for the Doctor in Philosophy in Business and Socioeconomic Sciences (hereinafter referred to as the “Study Program”) with reasonable care and skill, subject to this Agreement ▪ to use all reasonable means to deliver the Study Program in accordance with the description provided in the relevant curriculum ▪ to make available to the Student such learning support facilities, courses and other services in accordance with the curriculum, as it considers appropriate, and reserves the right to vary these offerings at any time ▪ to enable the Student to attend all courses at the University required for graduation in the chosen course of study ▪ to provide an appropriate substitute in the case of cancelled courses ▪ to educate the Student in accordance with the program’s Study and Examinations Regulations with the most recent version being available on the University website ▪ to provide the infrastructure necessary for due and proper completion of the Study Program ▪ to issue a certificate confirming the time period and contents of the Study Program, as well as final grades, graduation diplomas and academic degrees to the Student upon fulfillment of the required conditions ▪ to do its outmost to consider specific needs of students (e.g. physical or psychological disability) within the scope of its possibilities. Obligations of the University. 2.1 The University agrees to place the Student to perform the Research, and such other work as shall be reasonably requested by NNL from time to time, with due skill and care. The Research shall be carried out at the University premises (“University Premises”) or such other place as NNL may reasonably direct from time to time. The University shall provide all laboratories, computers and such other equipment required to perform v110219 Page 4 of 19 the Research where the Student is on University Premises but NNL shall provide the same if the Student is working at NNL’s Premises, such arrangements shall be subject to the terms of any Site Approval.
2.2 The University shall provide details to NNL of all its representatives who will work with or support the Student to perform the Research or who will have access to any NNL Intellectual Property for NNL to approve. Upon NNL providing the University with such approval, the University shall appoint:
2.2.1 the Student, who shall undertake the Research as set out in Appendix 1; and
2.2.2 the University Supervisor, who shall be stationed at the University and who shall be responsible for supervising the performance of the University’s obligations pursuant to this Agreement. The personal details of the University Representative are set out in Appendix 2, together the “University Representatives”. For the avoidance of doubt, if NNL shall not provide such approval, the Parties will meet to discuss a proposal to identify a different student or supervisor.
2.3 The University shall ensure that the University Representatives are suitable and willing to carry out the obligations as set out in Appendix 1 and shall ensure that the University Representatives perform their obligations with all due care and diligence, in a professional and ethical manner and in accordance with any guidelines notified by NNL to the University.
2.4 The University shall inform NNL immediately in writing in the event that (i) the Student ceases to be enrolled by the University; (ii) the Student ceases their studies or work on the Project for a period of two (2) months or longer or (iii) the University Supervisor ceases to be employed or engaged by the University, and use its best endeavours to seek replacement(s). The University shall forward the details of any potential replacement(s) to NNL, but shall not permit anyone to replace or act as the University Representatives unless NNL has previously agreed to the appointment in writing.

The resident may request correction of such conditions through either the Residence Director, Area Operations Office, or the determination of unsafe conditions may be made upon request by the Division of Environmental Health and Safety, which shall give written notification of its determination to the Area Operations Office in the area in which the request is made, and to the person(s) making the request.
