Obligations Related to the Total Area Offered to Maha-Metro. The Concessionaire shall be responsible for construction of the Project at the Project Site within the prescribed Construction Period and as per the terms and conditions of this Agreement. The Concessionaire shall construct the Total Area Offered in the form of Bareshell structure either as an integrated structure with the Project or on a standalone basis at the Project Site in good working condition along with securing necessary approvals from all statutory authorities including necessary utilities connections, associated infrastructure works. The location, type of structure, accessibility, floor level of the Total Area Offered shall match the Conceptual Layout submitted by the Successful Bidder/Concessionaire as part of its Financial Bid of the Project. Any change of the Total Area Offered shall be acceptable it is superior and efficient as compared to the Conceptual Layout and the same being approved by the Competent Authority of Maha-Metro. The Maha-Metro shall be responsible for the operation & maintenance of the Total Area Offered by the Concessionaire. Further, the Total Area Offered shall be measured in terms of the total Built-up area. However, the net usable/ leasable area (carpet area) i.e. areas excluding staircase, common areas, amenities, refuge areas, utilities, balconies, dedicated parking spaces etc. shall be atleast 75% of the total Area Offered. The parking requirements for such Total Area Offered shall be provisioned exclusively and earmarked at the time of sanctioning of the building plan and layout approval. No changes in layout, alignment, area etc. shall be permissible thereafter.
