Obligations relating to Mining Plan. The Mine Operator shall at all times conform with the provisions of the Mining Plan as specified in Schedule-D, or any modification thereof, as may be approved in accordance with Applicable Laws.
Obligations relating to Mining Plan. The Mine Operator shall prepare and procure approval of the Mining Plan, as provided in Clause 4.1.2 (c) of this Agreement.The Mining Plan shall be prepared and certified in accordance with the latest guidelines issued by the Ministry of Coal, Government of India.TheAuthorityshall submit application for the approval of the Mining Plan after its preparation and notice given by theMine Operator as mentioned in Clause 4.1.3(a) of this Agreement.The Mine Operator shall at all times conform to the provisions of the Mining Plan, or any modification thereof, as may be approved in accordance with Applicable Laws.TheMine Operator may propose the method of miningeither by Opencast Working, Underground Working,Highwall Working or any combination of Opencast Working, Underground Workingand Highwall Workingin the Mining Plan. The Mine Operator shall submit 2 (two) copies of the Mining Plan to the Authority. The Mining Plan shall be prepared in accordance with the Specifications and Standards and Standard Industry Practice. If extraction and commercial utilization of AMM or CMM is undertaken for the Project or any improvement in mining methodology is required to be adopted, the Mine Operator shall revise the Mining Plan as may be necessary due to extraction of AMM or CMM or adoption of any improved methodology. In such case, the Mine Operator shall prepare and procure approval of the revised Mining Plan in accordance with this Clause 5.13 and the Mine Operator shall follow such revised Mining Plan for the Xxxxxxx.Xx addition, the Mine Operator shall obtain Applicable Permits, as may be relevant for such extraction and commercial utilization of AMM or CMM. However, in no case the rated production should be less than the rated production given in mining scheme / approved Mining Plan.

The Mine Developer and Operator shall at all times conform with the provisions of the Mining Plan/ Revised Mining Plan as specified in Schedule-D or any modification thereof, as may be approved in accordance with Applicable Laws. Mining Plan is to be prepared for the non-forest area in Sector-II initially and revised mining plan is to be prepared for the entire area of the Sector-II including both the non-forest and forest areas after detailed exploration is completed in the forest area of Sector-II. The final mining plan shall be for the entire area of the block including Sector-I also. This MDO contract is for Open cast mining up to 350m depth in Sector-II or as per approved Mining Plan.
