Common use of Observation Summary Clause in Contracts

Observation Summary. 12.4.4.1 If by the time of the observation conference the prime evaluator has drafted an observation summary, he or she shall share the draft with the bargaining unit member upon request. As soon as possible, but no later than five (5) days after each observation conference, the prime evaluator shall also complete and distribute the observation form. Both evaluator and bargaining unit member shall then sign a summary of each formal observation, indicating receipt by the bargaining unit member. Items not discussed with the bargaining unit member in the observation conference shall not be included on the written observation form, unless a follow up observation conference occurs. 12.4.4.2 Signature of the bargaining unit member shall not imply either agreement or disagreement with the observation summary. 12.4.4.3 Bargaining unit member shall be given five (5) days to submit any written comments to be attached to any observation summary.
