Common use of Occupancy by Others Clause in Contracts

Occupancy by Others. Tenant may allow any person or company which is a client or customer of Tenant or which is providing service to Tenant or one of Tenant’s clients to occupy certain portions of the Premises without such occupancy being deemed an assignment or subleasing as long as no new demising walls are constructed to accomplish such occupancy and as long as such relationship was not created as a subterfuge to avoid the obligations set forth in this Section 18.

Any such occupancy shall not survive the expiration or termination of this Lease.

Tenant may allow any person or company entity which is a client or customer of Tenant or which is providing service to Tenant or one of Tenant’s clients to occupy certain portions of the Premises without such occupancy being deemed an assignment or subleasing as long as no new demising walls are constructed to accomplish such occupancy and as long as such relationship was not created as a subterfuge to avoid the obligations set forth in this Section 18Article 11 and so long as such occupancy is for not more than five percent (5%) of the Premises.

Tenant may allow any person or company which is a client or customer of Tenant or an affiliate or which is providing service to Tenant or an affiliate or one of Tenant’s or an affiliate’s clients to occupy certain portions of the Premises without such occupancy being deemed an assignment or subleasing as long as no new demising walls are constructed to accomplish such occupancy and as long as such relationship was not created as a subterfuge to avoid the obligations set forth in this Section 18Article 11.
