Ofsted judgement Good, Outstanding or Effective. 10.5.1 SCC will fund places for children eligible for working parents entitlement, FEET, and the universal entitlement at any Provider judged ‘good’ or ‘outstanding’ by Ofsted or at any childminder or childcare Provider registered with a childminder agency judged ‘effective’ by Ofsted if a parent wants their child to take up their funded place at that Provider, and the Provider is willing to accept the local authority funding and any other local authority requirements.

Ofsted judgement Good, Outstanding or Effective. 10.4.1 SCC will fund places for two, three and four year old children at any provider judged ‘good’ or ‘outstanding’ by Ofsted or at any childminder registered with a childminder agency judged ‘effective’ by Ofsted, as long as a parent wants their child to take up their funded place at that provider and the provider is willing to accept SCC’s funding requirements as set out in this agreement.

  • Termination Due To Lack Of Funding Appropriation If, in the judgment of the Director of Accounts and Reports, Department of Administration, sufficient funds are not appropriated to continue the function performed in this agreement and for the payment of the charges hereunder, State may terminate this agreement at the end of its current fiscal year. State agrees to give written notice of termination to contractor at least 30 days prior to the end of its current fiscal year, and shall give such notice for a greater period prior to the end of such fiscal year as may be provided in this contract, except that such notice shall not be required prior to 90 days before the end of such fiscal year. Contractor shall have the right, at the end of such fiscal year, to take possession of any equipment provided State under the contract. State will pay to the contractor all regular contractual payments incurred through the end of such fiscal year, plus contractual charges incidental to the return of any such equipment. Upon termination of the agreement by State, title to any such equipment shall revert to contractor at the end of the State's current fiscal year. The termination of the contract pursuant to this paragraph shall not cause any penalty to be charged to the agency or the contractor.

  • Retainage for Unacceptable Corrective Action Plan or Plan Failure If the corrective action plan is unacceptable to the Department or Customer, or implementation of the plan fails to remedy the performance deficiencies, the Department or Customer will retain ten percent (10%) of the total invoice amount. The retainage will be withheld until the Contractor resolves the performance deficiencies. If the performance deficiencies are resolved, the Contractor may invoice the Department or Customer for the retained amount. If the Contractor fails to resolve the performance deficiencies, the retained amount will be forfeited to compensate the Department or Customer for the performance deficiencies.

  • TERMINATION DUE TO CHANGE IN FUNDING ‌ 35 In the event funding from HCA, MCO, State, Federal, or other sources is withdrawn, reduced, or limited 36 in any way after the effective date of this Contract and prior to its normal completion, either party may 37 terminate this Contract subject to re-negotiations.

  • Processing on Legal Requirement SAP may also process Personal Data where required to do so by applicable law. In such a case, SAP shall inform Customer of that legal requirement before processing unless that law prohibits such information on important grounds of public interest.
