Common use of “On Duty” Status - Defined Clause in Contracts

“On Duty” Status - Defined. The Employer and the Bargaining Unit mutually recognize that certain services provided by the Employer are “short notice” in nature. Short notice events include, but are not limited to, weather-related events such as snow, flood, wind, etc.; unanticipated utility disruptions; unanticipated disruptions to the transportation system and other events of an unanticipated/unplanned nature that occur during periods of the day or week when staffing is at its lowest or no staff is on hand. These events result in the need to have personnel “On Duty” and to respond when called in order to initiate actions to stabilize the situation or to completely resolve the situation. Therefore, it is necessary to establish lists of personnel in “On Duty” status in advance to ensure the necessary personnel are readily available for short notice responses. For the benefit of both parties, the following processes are set forth:
