On-Site and Excess Soil Management. (a) Without limiting Project Co’s obligation to perform the Works at all times in accordance with Applicable Law, Project Co shall: (i) perform the respective obligations of the ‘project leader’ and the operator of the project area for the Project under Ontario Regulation 406/19 made under the Environmental Protection Act (Ontario); (ii) comply, and cause each Project Co Party to comply, with Applicable Law relating to the management of excavated and excess soil, including without limitation Ontario Regulation 406/19; (iii) develop and implement plans, procedures, assessments, and systems to ensure the Works are performed in compliance with all requirements of Ontario Regulation 406/19, including all such requirements applicable to Project Co in performing the respective obligations of the ‘project leader’ and the operator of the project area; and (iv) plan and complete all excess soil management activities required for the performance of the Works in compliance with the Ontario Ministry of Environment, Conservation, and Parks’ ‘Management of Excess Soil – A Guide for Best Management Practices – PIBS 9603e’ (as may be updated or amended from time to time).
