Operating Standards. In providing any of the required and/or authorized services or activities specified in this Agreement, LESSEE shall operate for the use and benefit of the public and shall meet or exceed the following standards: 1. LESSEE shall comply with the minimum operating standards or requirements, promulgated by DISTRICT, applicable to each of LESSEE's activities on the Airport. 2. LESSEE shall, furnish service on a fair, reasonable and nondiscriminatory basis to all users of the Airport. LESSEE shall furnish good, prompt and efficient service adequate to meet all reasonable demands for its services at the Airport. LESSEE shall charge fair, reasonable, and nondiscriminatory prices for each unit of sale or service; provided, however, that LESSEE shall be allowed to make reasonable and nondiscriminatory discounts, rebates, or other similar types of price reductions to volume or membership purchasers. 3. LESSEE shall select and appoint a full-time regional manager for its operations at the Airport. The manager shall be qualified and experienced, and vested with full power and authority to act in the name of LESSEE with respect to the method, manner and conduct of the operation of the rental car services to be provided under this Agreement. Because DISTRICT does not provide customer service for LESSEE, LESSEE shall also provide DISTRICT with a customer service phone number that shall be in service 24/7/365. 4. LESSEE Lessee shall control the conduct, demeanor demeanor, and appearance of its employees, who shall be trained by XXXXXX Lessee and who shall possess such technical qualifications and hold such certificates of qualification as may be required by any government authority in carrying out assigned duties. It shall be the responsibility of LESSEE Lessee to maintain close supervision over its employees to assure a high standard of service to customers of LESSEELessee.
IV. Lessee shall meet all expenses and payments in connection with the use of the Premises and the rights and privileges herein granted, including taxes, permit fees, license fees, and assessments lawfully levied or assessed upon the Premises or property at any time situated therein and thereon. Lessee may, however, at its sole expense and cost, contest any tax, fee, or assessment.
V. Lessee shall comply with all federal, state, and local laws, rules and regulations in all material respects which may apply to the conduct of the business contemplated, including rules and regulations promulgated by Lessor, and Lessee shall keep in effect and post in a prominent place all necessary and/or required licenses or permits.
VI. Lessee shall be responsible for the maintenance and repair of the Premises and keep and maintain the Premises in good condition, order, and repair; including such tasks as mowing and snow removal on the Premises. Lessee shall use all reasonable efforts to keep the Premises free from any environmental contamination arising out of Lessee’s operation. Lessee shall surrender the Premises upon the expiration of this Agreement, in the condition in which they are required to be kept, reasonable wear and tear and damage by the elements not caused by Lessee’s negligence excepted which, upon request of Lessor, shall include the removal of all or part of Lessee personal property at Lessee’s sole expense. It is expressly understood and agreed that, in providing required and authorized services pursuant to this Agreement, Lessee shall have the right to choose in its sole discretion, its vendors and suppliers.
VII. Lessee shall repair any damage to the premises and is responsible for remedying any environmental contamination arising out of Lessee’s operation. If during the term of this Agreement Lessee fails to keep the premises in good repair and free from environmental contamination, Lessor may, after providing Lessee with written notice and a fifteen (15) day period to correct the deficiency, enter the premises and do whatever repair or cleanup work the Lessor deems appropriate. The LESSEE must provide for cooked, prepared food offerings to the minimum operating standards or requirements, promulgated by DISTRICT, applicable to each public at large and cannot operate solely as a bar-beverage only establishment. Beverage service should offer a choice of LESSEE's activities on the Airportalcoholic and non-alcoholic offerings.
2. LESSEE shall, shall furnish service on a fair, reasonable and nondiscriminatory basis to all users of the Airport. LESSEE shall furnish good, prompt and efficient service adequate to meet all reasonable demands for its services advertised at the Airport. LESSEE shall charge fair, reasonable, and nondiscriminatory prices for each unit of sale or service; provided, however, that LESSEE shall be allowed to make reasonable and nondiscriminatory discounts, rebates, or other similar types of price reductions to volume purchasers or membership purchasersdiscounts for active duty military personnel and/or veterans of the U.S. armed services.

7. LESSEE shall accept customer payment via cash, Visa and Master Card at a minimum.
8. LESSEE must obtain a California Liquor License within first four (4) months of the establishment opening to the public.
9. LESSEE shall be responsible for the maintenance and repair of the Premises and shall keep and maintain the Premises in good condition, order and repair, and shall surrender the same upon expiration of this Agreement, in the condition in which they are required to be kept, reasonable wear and tear and damage by the elements not caused by XXXXXX’S negligence excepted.
10. It is expressly understood and agreed that, in providing required and authorized services pursuant to this Agreement, LESSEE shall have the right to choose, in its sole discretion, its vendors and suppliers.
11. No open or uninvited solicitation on the Airport of LESSEE’S services, except by signs as hereinafter provided, shall be done or permitted, and CITY shall be the sole judge as to whether or not the foregoing restriction has been violated and constitutes a breach of this Agreement.
12. LESSEE shall not store materials or supplies at the Airport outside of any buildings. LESSEE is responsible to provide for its own restaurant trash removal and is responsible to clean out the restaurant grease interceptor when full over the duration of the Agreement. The grease interceptor should be returned cleaned out at the termination of this Agreement.
13. LESSEE shall make no unlawful or offensive use of the Airport, nor commit or suffer or permit waste, excessive noise, obnoxious odors, excessive
14. XXXXXX agrees to keep the Premises clear and free of all litter, garbage, debris and refuse, and to keep such premises and area in an orderly and sanitary condition at all times.
15. LESSEE shall make a good faith effort to mitigate any and all impacts on CITY and CITY’S employees, guests, invitees and other Tenants from LESSEE’S activities, including but not limited to noise, vibration, odor, steam or other emissions. If CITY determines, in the reasonable exercise of its discretion, that XXXXXX has failed to mitigate the impact of XXXXXX’S activities after reasonable attempts, it is understood that CITY may reasonably restrict XXXXXX'S activities that negatively impact others.
