Common use of Operation of this Agreement Clause in Contracts

Operation of this Agreement. 4.1 This Agreement takes effect on its execution by the Parties but the Parties agree that the Developer is not required to make the Development Contribution in accordance with clause 6 of this Agreement unless and until such time as each of the following conditions precedent have been satisfied:‌ (a) a Construction Certificate is granted in relation to the construction of the Development; and (b) the carrying out of the Development has commenced.

Operation of this Agreement. ‌ 4.1 This Agreement takes effect on its execution by the Parties but the Parties agree that the Developer is not required to make the Development Contribution in accordance with clause 6 of this Agreement unless and until such time as each of it has obtained a Development Consent for the following conditions precedent have been satisfied:‌Development.‌ 4.2 This Agreement will remain in force until the earlier of: (a) a Construction Certificate is granted in relation to when all obligations under the construction of the DevelopmentAgreement are performed or satisfied; andor (b) when any Development Consent obtained by the carrying Developer to carry out of the Development has commencedlapsed or been surrendered.
