Common use of OPERATOR'S FEE Clause in Contracts

OPERATOR'S FEE. 11.1 The Operator may charge the following sums in return for its head office overhead functions which are not charged directly: (a) with respect to Programs: (i) 2% for each individual contract which expressly includes an overhead charge by the party contracted; (ii) 5% for each individual contract which exceeds $50,000 and is not subject to Section 11.1(a)(i) hereof; or (iii) 10% of all other Costs not included in Sections 11.1(a)(i) and 11.1(a)(ii); (b) with respect to Construction: 1% of all other such Costs; and (c) subsequent to the Completion Date: 3.5% of all Operating Costs.

OPERATOR'S FEE. 11.1 The Operator may charge the following sums in return for its head office overhead functions which are not charged directly: (a) with respect to Programs: (i) 210% for each individual contract which expressly includes an overhead charge by the party contracted; (ii) 58% for each individual contract which exceeds $50,000 1,000,000 and is not subject to Section 11.1(a)(iclause 11.01(a)(i) hereof; or; (iii) 108% of all other Costs not included in Sections 11.1(a)(iclauses 11.01(a)(i) and 11.1(a)(ii11.01(a)(ii);. (b) with respect to Construction: 110% of all other such Costs; and; (c) subsequent to the Completion Date: 3.55% of all Operating Costs.

OPERATOR'S FEE. 11.1 11.01 The Operator may charge the following sums in return for its head office overhead functions which are not charged directly: (a) with respect to Programs: (i) 2% two percent for each individual contract which expressly includes an overhead charge by the party contracted; (ii) 5% five percent for each individual contract which exceeds $50,000 and is not subject to Section 11.1(a)(iclause 11.01(a)(i) hereof; or; (iii) 10% 10 percent of all other Costs not included in Sections 11.1(a)(iclauses 11.01(a)(i) and 11.1(a)(ii11.01(a)(ii);. (b) with respect to Mine development and Construction: 1% three percent of all other such Costs; and; (c) subsequent to the Completion Date: 3.5% two percent of all Operating Costs.

OPERATOR'S FEE. 11.1 12.1 The Operator may charge the following sums in return for its head office overhead functions which are not charged directly: (a) with respect to Programs: (i) 2% for each individual contract which expressly includes an overhead charge by the party contracted; (ii) 5% for each individual contract which exceeds $50,000 and is not subject to Section 11.1(a)(i) hereof; or (iii) Programs 10% of all other Costs not included in Sections 11.1(a)(i) and 11.1(a)(ii(excluding Maintenance Costs); (b) with respect to Construction: 14% of all other such Costs (excluding Maintenance Costs); and (c) subsequent to the Completion Date: 3.52.5% of all Operating Costs(excluding Maintenance Costs).
