Opinions and Determinations. Consistent with Article 38 of the SWP Contracts, where the terms of this sub- article 45(k) provide for action to be based upon the opinion, approval, review, or determination of any party, such terms are not intended to be and shall never be construed as permitting such opinion, approval, review, or determination to be arbitrary, capricious, or unreasonable.
