Other business and conflict of interest. 7.8.1 A ’conflict of interest’ occurs when an individual uses his/her position to take advantage or influence the outcome of a decision, for his/her personal benefit. 7.8.2 In the performance of duties under this Agreement the employee agrees not to: a) Have or permit to exist any ‘conflict of interest’ with the employer, unless the employee at the earliest opportunity has declared all facts establishing the ‘conflict of interest’ to the employer and obtained the employer’s consent in writing to the existence of that conflict; or b) Accept payment or other benefits in money or kind from any other person as an inducement or reward for any act in connection with any matter transacted or to be transacted by the employer. 7.8.3 The employee agrees to inform the employer in writing of any potential conflict of interest which may occur arising out of the employee’s employment, time commitment or interest either directly or indirectly in any other business, trade, occupation or activity. This does not prevent the employee from reasonable involvement in any professional or educational activity or body provided disclosure in writing is made to the employer. 7.8.4 Arising matters shall be resolved in accordance with the dispute resolution clause12.0 of this Agreement.
