Common use of Out-of-Schedule Positions Clause in Contracts

Out-of-Schedule Positions. In the event that the evaluated hourly rate of pay for a position is not competitive in the market place, the City may set an “out of schedule” hourly pay rate above the evaluated rate. All employees in classifications that are adjusted because of the market will be moved to the “out of schedule” classification hourly pay rate. Employees receiving “out of schedule” pay rates will be given six (6) months notice in writing of any reduction or cancellation of the “out of schedule” rates. The union shall be notified as positions are added.
