Common use of OVERHEAD HIGH VOLTAGE LINES SAFETY ACT Clause in Contracts

OVERHEAD HIGH VOLTAGE LINES SAFETY ACT. If any Work required herein will be performed within ten (10) feet of an overhead high voltage line, the provisions of Code of Virginia §59.1-406, et. seq., “Overhead High Voltage Line Safety Act” (the “Act”) shall apply. The “person or contractor responsible for the work to be done”, as that term is used in the Act, will be interpreted to mean Contractor. Contractor shall notify the owner or operator of the high voltage line in the manner prescribed in Section 59.1-411 of the Act in sufficient time prior to the time Work is to be commenced to avoid any delays in the Work. The City will not pay for lost time, profits, or permit any extension of the Work for any delays caused by the failure of Contractor to make such arrangements in a timely manner. All costs for the Work shall be paid by Contractor. The City shall reimburse Contractor for the actual reasonable cost paid to the owner or operator of the high voltage line by Contractor on presentation to the City by Contractor of original invoices from the owner or operator of the high voltage line in the same manner as for other Contractor invoices submitted for Work performed. Retention, if applicable to the Agreement, shall not be withheld from the payment to Contractor by the City for this Work. No processing, administrative, or other charges above the actual amount charged by the owner or operator of the high voltage line shall be paid to Contractor by the City.
