Common use of Owner-Directed Suspension Clause in Contracts

Owner-Directed Suspension. Owner may, upon five (5) Business Days’ prior written notice to Contractor, direct Contractor to suspend its performance of all or any portion of the Work; provided that no prior written notice shall be required if such suspension is due to an Emergency or is otherwise required by Applicable Law. Upon the commencement of the suspension, Contractor shall stop the performance of the suspended Work except as may be necessary to carry out the suspension and protect and preserve the Work completed prior to the suspension. Contractor shall thereafter resume any suspended Work upon receipt of a written direction from Owner to resume the Work. Except as otherwise provided in Section 11.2, any period of Owner-directed suspension that extends beyond thirty (30) Days shall constitute an Owner-Caused Delay.
