Emergency Suspension. The Union and the District recognize that emergency situations can occur involving the health and welfare of students, employees, or the public.
19.3.3.1.1 If the unit member’s presence would lead to a clear and present danger to the lives, safety, or health of students, employees, or the public, the District may suspend the unit member without pay immediately after informing the unit member of the reason for the suspension.
19.3.3.1.2 Within three (3) work days, the District shall hold an informal hearing as described in Section 19.4.1 and serve on the employee a written notice of discipline and notice of right to a formal hearing in accordance with this Article.
19.3.3.1.3 If, as a result of either the informal or formal hearing, the suspension is found unwarranted or of undue length, the unit member shall be reimbursed the appropriate back pay.
Emergency Suspension. Notwithstanding the provisions of the Article Discipline, the President or designate may suspend a Member with full pay where:
Emergency Suspension. 13.1 Any person holding the rank of sergeant or above shall have the authority to impose emergency suspension with pay until the next business day against a member when it appears that such action is in the best interest of the department.

Emergency Suspension. If in the opinion of the Superintendent or his/her designee, a bargaining unit member’s presence would lead to a clear and present danger to lives, safety and health of students or fellow employees, the Board may immediately suspend the unit member without pay.
1. In the emergency suspension, the bargaining unit member can request a meeting to be held within three (3) work days of the suspension.
2. Bargaining unit member may grieve emergency suspensions directly to Level two of the grievance procedure.
Emergency Suspension. 1. Pending investigation by the District of accusations against a unit member involving insubordination, misappropriation of public funds or property, furnishing drugs to students of the District, committing any sex offense as defined in Education Code 87010 or Penal Code 261.5 on District grounds or adjacent thereto, or during a District field trip or outing, assault or battery upon another person while on the job or while on District premises or adjacent thereto or while on a District field trip or outing, committing any act of immorality, or any act which would constitute a felony or a misdemeanor involving moral turpitude, or any act which presents a risk to person or property, the District Chancellor or his/her designee may, without complying with the Procedure for Disciplinary Action and Appeal, suspend the unit member. During this suspension, the unit member will remain in paid status. The suspension may be terminated by the District by giving a twenty-four (24) hour written notice to the unit member.
2. An emergency suspension does not preclude the imposition of due process as established by this Article.
Emergency Suspension. CSEA and the District recognize that emergency situations can occur involving the health and welfare of students or employees. If the employee's presence would, in the judgment of the Superintendent, or designee, be a danger to the lives, safety or health of students, or fellow employees, the District may immediately suspend the employee. Such suspension shall be with pay until the employee has been given the written notice described in 12.7 above. Thereafter the employee may be suspended with or without pay.
Emergency Suspension. A. Emergency situations can occur involving the health and welfare of students or employees. If the employee’s presence presents a clear and present danger to the life, safety, or health of any student or employee or themselves as determined by the District, the District may immediately suspend or relieve from duty the employee for three (3) days.
B. During the three (3) days, the District shall serve notice and a statement of facts upon the employee who shall be entitled to respond to the factual contentions supporting the emergency.
Emergency Suspension. CSEA and the District recognize that emergency situations can arise involving the health and safety of students, staff and the public, and the security of District property. If an employee's continued presence on District property would lead to a clear and present danger to the lives, safety or health of students, employees or the public, or a serious risk to the security of District property, the District may immediately suspend an employee with pay. During the first day of any such suspension, the District shall provide the employee with written notice of the cause for the suspension. If the suspension involves disciplinary potential, the District shall promptly provide the suspended employee with the required notice and written charges. No suspension without pay may occur for any employee except as a result of the formal hearing process contained herein, or if an employee does not deny charges and demand a hearing in a timely fashion.
Emergency Suspension.
13.1 The Sheriff, or designee, may impose an immediate suspension without pay in advance of the conclusion of any of the procedures set forth in the grievance and arbitration article or in the Civil Service and Personnel Rules and Regulations in the following cases:
A. When an employee has been arrested on a felony charge (other than arrests for incidents occurring in the "good faith" performance of their duties, such as accidental shootings);
B. When an employee fails a substance abuse test (with confirmation);
C. When an employee fails to obey a lawful direct order from a superior officer; or
D. When an employee is a danger to himself/herself or others.
13.2 The immediate emergency suspension without pay must be issued by the Division Chief or above.
13.3 Upon request of the employee, within the next business day after an immediate emergency suspension, the employee will be afforded the opportunity to meet with the assigned Division Chief for the purpose of coordinating a meeting between the Sheriff or designee and the employee to determine any further action that may be taken.
13.4 An employee who is placed on emergency suspension shall be allowed to use his/her own personal leave from their respective leave accounts (AL, CL or HOL).
