Common use of Owner Elective Improvements Clause in Contracts

Owner Elective Improvements. During the Term of this Agreement, Owner shall have the right, at Owner's sole cost and expense, to make any modifications, additions or improvements to the Stadium Facility that Owner deems to be necessary or desirable in Owner's sole discretion, whether structural or non-structural (the "Elective Improvements"), without Manager's consent or approval as long as such improvements do not impair or increase the cost of Manager's exercise of its rights or performing its obligations hereunder. With regard to the Elective Improvements, Manager and Owner agree as follows: (a) Owner may enter the Premises at any time for purposes related to making the Elective Improvements, and without liability to Manager for any loss or damage incurred as a result of such entry; and (b) Owner agrees to use reasonable efforts to minimize the interference with the conduct of Manager's management duties and baseball operations and the requirements of the League in making any such Elective Improvements.
