Packet Switching Capability. 4.5.1 The packet switching capability network element is defined as the function of routing or forwarding packets, frames, cells or other data units based on address or other routing information contained in the packets, frames, cells or other data units. 4.5.2 BellSouth shall be required to provide non-discriminatory access to unbundled packet switching capability only where each of the following conditions are satisfied: 4.5.2.1 BellSouth has deployed digital loop carrier systems, including but not limited to, integrated digital loop carrier or universal digital loop carrier systems; or has deployed any other system in which fiber optic facilities replace copper facilities in the distribution section (e.g., end office to remote terminal, pedestal or environmentally controlled vault); 4.5.2.2 There are no spare copper loops capable of supporting the xDSL services Louisville Telephone seeks to offer; 4.5.2.3 BellSouth has not permitted Louisville Telephone to deploy a DSLAM at the remote terminal, pedestal or environmentally controlled vault or other interconnection point, nor has Louisville Telephone obtained a virtual collocation arrangement at these sub-loop interconnection points as defined by 47 CFR § 51.319 (b); and 4.5.2.4 BellSouth has deployed packet switching capability for its own use. 4.5.3 If there is a dispute as to whether BellSouth must provide Packet Switching, such dispute will be resolved according to the dispute resolution process set forth in Section 12 of the General Terms and Conditions of this Agreement, incorporated herein by this reference.

4.5.2.4 BellSouth has deployed packet switching capability for its own use.

4.5.3 If there is a dispute as to whether BellSouth must provide Packet Switching, such dispute will be resolved according to the dispute resolution process set forth in Section 12 10 of the General Terms and Conditions of this Agreement, Agreement incorporated herein by this reference.
