UNE Port/Loop Combinations. 5.3.1 Combinations of port and loop unbundled Network Elements along with switching and transport unbundled Network Elements provide local exchange service for the origination or termination of calls. Port/loop combinations support the same local calling and feature requirements as described in the Unbundled Local Switching or Port section of this Attachment and the ability to presubscribe to a primary carrier for intraLATA toll service and/or to presubscribe to a primary carrier for interLATA toll service. 5.3.2 BellSouth is not required to provide combinations of port and loop Network Elements on an unbundled basis in locations where, pursuant to FCC and Commission rules, BellSouth is not required to provide local circuit switching as a UNE. 5.3.3 BellSouth shall not be required to provide local circuit switching as a UNE in density Zone 1, as defined in 47 CFR 69.123 as of January 1, 1999 of the Nashville, TN; and New Orleans, LA, MSAs to Victory if Victory’s customer has four (4) or more DS0 equivalent lines. 5.3.4 BellSouth shall not be required to provide local circuit switching as a UNE or combination of UNEs if the End User is being served by a BellSouth DS1 or higher capacity Loop in any service area covered by this Agreement. To the extent that Victory is serving any End User as described above as of October 2, 2003, such arrangement may not remain in place any longer than April 1, 2004, after which such arrangement must be terminated by Victory or BellSouth shall convert such arrangement to tariff pricing. The filing of this Amendment with the applicable Commission shall constitute the filing of the joint transition plan specified by the FCC. 5.3.5 BellSouth shall make 911 updates in the BellSouth 911 database for Victory’s UNE port/Loop combinations. BellSouth will not xxxx Victory for 911 surcharges. Victory is responsible for paying all 911 surcharges to the applicable governmental agency.
