Common use of Parking and Loading Areas Clause in Contracts

Parking and Loading Areas. (a) During the Term of this Lease, and any renewal thereof, Tenant shall have, without charge, the right to utilize thirty one (31) vehicle parking spaces in the Building’s parking facilities on a nonexclusive basis with other tenants of the Building, upon such non-financial terms and conditions as may from time to time be established by Landlord. Landlord reserves the right in its absolute discretion to determine whether the parking facilities are becoming crowded and to allocate and assign parking spaces among Tenant and the other tenants, provided that Tenant shall at all times have a right to use its pro rata share of parking spaces within the parking facilities, including the right to a pro rata number of reserved parking spaces, if any. It is understood and agreed that Landlord assumes no responsibility, and shall not be held liable, unless caused by Landlord’s negligence, for any damage or loss to any automobiles parked in the parking facilities or to any personal property located therein, or for any injury sustained by any person in or about the parking facilities. (b) During the Term of this Lease, and any renewal thereof, Tenant shall have, without charge, the right to utilize the paved areas adjacent to the Premises which have been designed and constructed for use as loading docks to serve the Premises and to provide access to the drive in door in the Premises. Landlord shall not be liable to Tenant as a result of any inability of Tenant to access such docks or drive in door due to the parking of vehicles in the vicinity of such loading docks and drive in area, or otherwise. Tenant may, at its sole expense, and subject to the reasonable approval of Landlord as to size, design, color, content and location, post signs on the exterior of the Premises to attempt to restrict parking in the vicinity of such loading docks and drive in area.

Tenant shall be responsible for enforcing these restrictions with respect to sizetrucks making pickups and deliveries at the Premises, design, color, content and location, post signs on or otherwise serving the exterior of the Premises to attempt to restrict parking in the vicinity of such loading docks and drive in areaPremises.

Parking and Loading Areas. Landlord reserves shall not grant unto any other tenant of TransDulles Centre the right to park vehicles in its absolute discretion to determine whether the parking facilities are becoming crowded and to allocate and assign parking spaces among Tenant and the other tenants, provided that Tenant shall at all times have a right to use its pro rata share of parking spaces within the such parking facilities, and Landlord shall use commercially reasonable efforts to prohibit any such other tenant from parking vehicles in such parking facilities, but in no event shall Landlord have any obligation to impose any physical barrier to use of the parking area by parties other than Tenant, its employees, invitees, vendors, suppliers and contractors, or to tow vehicles from the parking area. Parking is specifically prohibited on the streets adjacent to the Building, including Xxxxx Drive, Xxxxx Xxxx Drive, and Xxxxx Drive. Tenant shall be responsible for monitoring and enforcing these restrictions with respect to the right to a pro rata number of reserved parking spacesvehicles used by its employees, if anyvendors, suppliers and contractors, and by parties visiting the Premises. It is understood and agreed that Landlord assumes no responsibility, and shall not be held liable, unless caused by Landlord’s negligence, for any damage or loss to any automobiles parked in the parking facilities or to any personal property located therein, or for any injury sustained by any person in or about the parking facilities, or for and claim arising from the unauthorized use of the parking areas by any party other than Tenant, its employees, invitees, vendors, suppliers and contractors, regardless of the cause. The parking facilities and areas adjacent to the loading docks serving the Premises may not be used for storage or repair of vehicles. (b) During the Term of this Lease, and any renewal thereof, Tenant shall have, without charge, the right to utilize the paved areas adjacent to the Premises which have been designed and constructed for use as loading docks to serve serving the Premises for shipping and to provide access to the drive in door in the Premisesreceiving. Landlord shall not be liable to Tenant as a result of any inability of Tenant to access such docks or drive in door due to the parking of vehicles in the vicinity of such loading docks and drive in areadocks, or otherwise. Tenant mayTruck parking shall be restricted to such loading docks, at its sole expenseand, and subject to applicable governmental restrictions, to the reasonable approval of Landlord as to size, design, color, content and location, post signs on areas in the exterior rear of the Premises to attempt to restrict parking Building in the vicinity of such loading docks identified in Exhibit G as the truck Parking Area. Truck parking is specifically prohibited in the parking areas located in front of and drive in areaon the sides of the Building designated for automobiles, and on the streets located adjacent to the Building, including Xxxxx Drive, Xxxxx Xxxx Drive, and Xxxxx Drive. Tenant shall be responsible for enforcing these restrictions with respect to trucks making pickups and deliveries at the Premises, or otherwise serving the Premises.
