Common use of Partial Return of the Development Security Clause in Contracts

Partial Return of the Development Security. If the Commercial Operation Date occurs on or before the Commercial Operation Deadline, but Seller is only able to demonstrate a portion of the Contract Capacity in accordance with the procedure set forth in Exhibit L (the “Demonstrated Contract Capacity”) by the Firm Operation Date, then Seller will be entitled to a return of only a portion of the Development Security equal to the product of [Ninety dollars ($90) for Baseload] [Sixty dollars ($60) for Intermittent] per kilowatt times the kilowatts of Demonstrated Contract Capacity.
