Common use of Participant Users and HSPs Clause in Contracts

Participant Users and HSPs. Each Participant shall require that all of its Participant Users and HSPs use the NHIN only in accordance with the terms and conditions of this Agreement, including without limitation those governing the use, confidentiality, privacy, and security of Message Content. Each Participant shall discipline appropriately any of its employee Participant Users, or take appropriate contractual action with respect to contractor Participant Users or HSPs, who fail to act in accordance with the terms and conditions of this Agreement relating to the privacy and security of Message Content, in accordance with Participant’s employee disciplinary policies and procedures and its contractor and vendor policies and contracts, respectively.
