Common use of PARTICIPATION OF CONTRACTOR IN THE SYSTEM Clause in Contracts

PARTICIPATION OF CONTRACTOR IN THE SYSTEM. a. As soon as reasonably practicable after execution of this Agreement, Contractor shall provide to FSHA the following information about Contractor’s employment needs under the Contract: i. Projected Entry Level Position employment needs under the Contract and a description of such needs by Job Classification, weekly hours required, wages to be paid, and duration of employment. ii. Notification of projected hiring schedule and procedures for each Entry Level Position, including the time and place of hiring for each Entry Level Position. b. Contractor must promptly deliver to FSHA a Job Notification for any available Entry Level Position, as they become available during the term of the Contract, prior to any other efforts of Contractor to Publicize such Entry Level Position in accordance with the following: The Job Notification must provide to FSHA a clear, minimum bona fide occupational qualifications and accurate job description, including expectations, standard of appearance, weekly hours required, wages to be paid, duration of employment, and any special requirements (for example, language skills, passage of a drug test by the prospective employee, and possession of a valid driver’s license by the employee). Job descriptions must be in accord with skills, knowledge, and abilities that are standard for that industry. For a period of 10 calendar days after FSHA’s receipt of the Job Notification, Contractor must refrain from seeking job applicants for the Entry Level Position included in the Job Notification from other sources. During this period, Contractor may only Publicize the availability of said Entry Level Positions by calling the System Referral number: (000) 000-0000. Contractor must (A) give good faith consideration to all System Referrals, (B) review the resumes of all such System Referrals, and (C) conduct interviews for posted Entry Level Positions in accordance with the non-discrimination provisions of this contract. Contractor must provide constructive feedback to FSHA on all System Referrals in accordance with the following: (A) If Contractor meets the criteria in Section 5(a) below that establishes “good faith efforts” of Contractor, Contractor must only respond orally to follow-up questions asked by the FSHA account executive regarding each System Referral; and (B) After Contractor has filled at least 5 Entry Level Positions under this Agreement, if Contractor is unable to meet the criteria in Section 5(a) below that establishes “good faith efforts” of Contractor, Contractor will be required to provide written comments on all System Referrals. Contractor must provide timely notification to FSHA as soon as the job is filled, and identify by whom.
