Common use of Parts of Modified Design Clause in Contracts

Parts of Modified Design. 1. CFM shall have the right to make modifications to design or changes in the spare Parts sold to Airline hereunder which improves the quality or performance of the parts without any adverse effect on weight, reliability or maintainability. In case a change in design renders any of Airline stock of Spare Parts unserviceable, CFM will replace them with newly modified parts at no charge to Airline and Airline promptly will return the unserviceable stock of Spare Parts to CFM At CFM’s expense. 2. CFM will from time to time inform Airline in accordance with the means set forth in ATA Specification 2000, when such spare Parts of modified design become available for shipment hereunder. 3. Spare Parts of the modified design will be supplied unless Airline advises CFM in writing of its contrary desire within ninety (90) days of the issuance of the service bulletin specifying the change to the modified Parts. In such event, Airline may negotiate for the continued supply of spare Parts of the pre-modified design at a rate of delivery and price to be agreed upon.
