PATROL PERFORMANCE. On a monthly basis, EIU will randomly select one (1) of the Contractor’s established patrol routes for evaluation of the Contractor's Patrol Performance in its Maintenance Area. The patrol route will be surveyed by the EIU to identify Device(s) outage(s) and/or other unsatisfactory condition(s). In the event that the EIU discovers any Device(s) outage(s) or other unsatisfactory condition(s) during their initial evaluation, on the twentieth (20th) Day after such evaluation, the EIU will re-evaluate such Device(s) for any and all outage(s) and/or other unsatisfactory condition(s) previously detected by the EIU. All locations where the EIU confirms during the re-evaluation the presence of a defect that the Contractor failed to remediate during its patrol, except those locations where the Device(s) had no electrical current (i.e., “no-currents”) or locations for which the Contractor obtained an extension of time from NYCDOT, will be included in the assessment of Liquidated Damages against the Contractor pursuant to Section 4.10.4.1.

  • School Performance The School shall achieve an accountability designation of Good Standing or Honor on each of the three sections of the Performance Framework. In the event the School is a party to a third party management contract which includes a deficit protection clause, the School shall be exempt from some or all measures within the financial portion of the Performance Framework. In accordance with Charter School Law, the Authorizer shall renew any charter in which the public charter school met all of the terms of its performance certificate at the time of renewal.

  • Service Performance All Services provided by the Agency shall be performed in a diligent, safe, courteous, and timely manner in accordance with this Contract and the Associated federal requirements.

  • Work Performance All work in performance of this Lease shall be done by skilled workers or mechanics and shall be acceptable to the RECO. The RECO may reject the Lessor’s workers 1) if such are unlicensed, unskilled, or otherwise incompetent, or 2) if such have demonstrated a history of either untimely or otherwise unacceptable performance in connection with work carried out in conjunction with either this contract or other Government or private contracts.

  • Full Performance The Owner and the Contractor hereby agree to the full performance of the Contract Documents.

  • Continuing Performance Each party is required to continue to perform its obligations under this contract pending final resolution of any dispute arising out of or relating to this contract, unless to do so would be impossible or impracticable under the circumstances.

  • POOR PERFORMANCE Authorized Users should notify NYSPro Customer Services promptly if the Contractor fails to meet the requirements of the contracts resulting from this solicitation.   • CONTRACTOR PERFORMANCE Agencies shall report any vendor failure to perform according to the requirements of this contract on Complaint to Vendor, form PUR 7017. Should the vendor fail to correct the problem within a prescribed period of time, then form PUR 7029, Request for Assistance, is to be filed with this office.

  • Excused Performance 6.1 Notwithstanding the occurrence of a Force Majeure Event, in which case Clause 17 will govern, BT will not be liable for any failure or delay to perform any of its obligations under this Agreement (including any of its obligations to meet any Service Levels) to the extent that BT’s failure or delay in performing arises as a result of:
