Common use of Paycheck and Payroll Errors Clause in Contracts

Paycheck and Payroll Errors. Any payroll error resulting in an underpayment to an employee shall be corrected and a supplemental check issued not later than five workdays following the determination by the school district that an error occurred. If a payroll error occurs resulting in an overpayment to an employee, the District Business office shall meet with the employee, reach an agreement on the amount of the overpayment, and agree upon how the District shall recover the overpayment. (For example, if the overpayment is five percent or less of the employee’s next net paycheck [as corrected prospectively], the agreement could provide that the overpayment would be deducted from the employee’s next paycheck. If the total overpayment amounts to more than five percent but less than fifteen percent of the employee’s next net paycheck [as corrected prospectively], the agreement could provide that the total overpayment would be recovered equally from the next two paychecks. If the total overpayment amounts to fifteen percent or more of the employee’s next net paycheck [as corrected prospectively], the agreement could provide that the total overpayment would be recovered equally from the next six paychecks. The employee and the superintendent or his/her designee could agree to other methods of repayment.)
