Common use of Payment of Sick Leave on Separation Clause in Contracts

Payment of Sick Leave on Separation. a) For Officers hired on or before the effective date of this Agreement with at least sixteen (16) years of actual service who separate in good standing, separation pay for accrued sick leave will be paid as follows: An Officer shall not be considered to have separated in good standing if he/she is indefinitely suspended or leaves the Department in lieu of termination. Except as provided in the following paragraph, the maximum accrued sick leave payable will be 1400 hours. The maximum accrued sick leave payable will be increased to 1700 hours if, in addition to the above requirements, the Officer has not used more than 80 hours of sick leave in either of the two prior twelve month periods before the date of separation, and has not used more than 120 hours cumulative in the prior 24 month period before the date of separation. The Chief shall have the right to grant hardship approval for use of leave above these amounts on the basis of actual documented medical conditions or treatment justifying the absence. For former PSEM officers, the sixteen (16) years requirement under section 3(a) shall be calculated using total City of Austin years of service, not strictly years of service at APD.
