Payment of Taxes, Assessments and Other Charges. Borrower confirms that:
Payment of Taxes, Assessments and Other Charges. Borrower shall file all federal, state, county and municipal tax returns and reports required to be filed by Borrower and shall pay, before any fine, penalty, interest or cost may be added thereto, all taxes payable with respect to such returns and reports.
Payment of Taxes, Assessments and Other Charges. (a) Subject to Section 1.07 relating to contests, the Mortgagor shall pay before penalty might attach for nonpayment thereof, all taxes and assessments and all other charges whatsoever levied upon or assessed or placed against the Mortgaged Property, except that assessments may be paid in installments so long as no fine or penalty is added to any installment for the nonpayment thereof. Mortgagor shall likewise pay any and all governmental levies or assessments such as maintenance charges, owner association dues, charges, or fees, levies or charges resulting from covenants, conditions, and restrictions affecting the Mortgaged Property, which are assessed or imposed upon the Mortgaged Property or any part thereof or become due and payable, and which create, may create, or appear to create a lien upon the Mortgaged Property, or any part thereof. Mortgagor shall likewise pay all taxes, assessments, and other charges, levied upon or assessed, placed, or made against, or measured by, this Mortgage, or the recordation hereof, or the indebtedness secured hereby, provided that the Mortgagor shall not be obliged to pay such tax, assessment, or charge if such payment would be contrary to law or would result in the payment of an unlawful rate of interest on the indebtedness secured hereby; and provided further that nothing herein contained shall be construed as requiring Mortgagor to pay any net income, profits, or revenue taxes of Mortgagee. Mortgagor shall promptly furnish to the Mortgagee all notices received by the Mortgagor of amounts due under this paragraph and in the event Mortgagor shall make payment directly, Mortgagor shall promptly furnish to Mortgagee receipts evidencing such payments.

To pay all and singular such taxes, assessments and public charges as are already levied or assessed or that may be hereafter levied or assessed upon or against the Property, when the same shall become due and payable according to law, before the same become delinquent, and before any interest or penalty shall attach thereto, and to deliver official receipts evidencing the payment of the same to the Lender not later than thirty (30) days following the payment of the same. Borrower shall have the right to contest, in good faith, the proposed assessment of ad valorem taxes or special assessments by governmental authorities having jurisdiction of the Property; provided, however, the Borrower shall give written notice thereof to Lender and Lender may, in its sole discretion, require Borrower to post a bond or other collateral satisfactory to Lender in connection with any such action by Borrower; provided further, however, that so long as there is no default hereunder (which is not cured within any applicable cure period, if any) Lender agrees not to require Borrower to post a bond or other collateral if (i) Borrower is appealing ad valorem taxes in the normal course of Borrower's business and (ii) no action is taken to commence foreclosure procedures on the Property or any portion thereof and (iii) the collateral pledged to Lender to secure the loan evidenced by the Note and this Security Deed is not otherwise jeopardized in Lender's sole opinion.

Borrower shall have the right to contest, in good faith and in accordance with applicable Laws and procedures, the proposed assessment of ad valorem taxes or special assessments by governmental authorities having jurisdiction over the Property; provided, however, Borrower shall give Written Notice of its intent to bring such an action to Lender, and Lender may, in its sole discretion, require Borrower to post a bond or other collateral satisfactory to Lender (and acceptable to the title company insuring this Mortgage) as a result of Xxxxxxxx’s act.

Except as otherwise provided in the Ground Lease, Grantor shall pay all taxes, assessments, and other charges that are or may be hereafter levied or assessed upon or against the Property, when the same shall become due and payable according to law, before the same become delinquent, and before any interest or penalty shall attach thereto. Grantor shall deliver official receipts evidencing the payment of the same to Beneficiary not later than thirty (30) days following payment. Grantor shall have the right to contest, in good faith, the proposed assessment of ad valorem taxes or special assessments by governmental authorities having jurisdiction over the Property; provided, however, Grantor shall give written notice thereof to Beneficiary and Beneficiary may, in its sole discretion, require Grantor to post a bond or other collateral satisfactory to Beneficiary in connection with any such action by Grantor.

Borrower shall pay all taxes, assessments and other similar charges as already levied or assessed, or that may be hereafter levied or assessed, upon or against the Property, when the same shall become due and payable according to Law, before delinquency and before any interest or penalty shall attach thereto, and to deliver official receipts evidencing the payment of the same to Lender not later than thirty (30) days following the payment of the same. Borrower shall have the right to contest, in good faith and in accordance with applicable Laws and procedures, the proposed assessment of ad valorem taxes or special assessments by governmental authorities having jurisdiction over the Property; provided, however, Borrower shall give Written Notice of its intent to bring such an action to Lender. Any such contest, however, shall not relieve Borrower of its obligation to pay all taxes, assessments and similar charges in full as required by the first sentence of this Section 4, and Lender may, in its sole discretion, require Borrower to post a bond or other collateral satisfactory to Lender (and acceptable to the title company insuring this Mortgage to insure over said lien, charge or encumbrance) as a result of Borrower's act.
