Common use of Payment on Death Clause in Contracts

Payment on Death. 25.7.1 Where an employee dies during employment and any long service leave to which the employee is entitled under the conditions of this Agreement has not been taken or received in full, then the money value of the long service leave not taken or received shall be paid or applied in whole or in part at the discretion of the employer to or for the benefit of one or more of the following as the employer in its discretion shall determine: ▪ the widow or widower of the employee; ▪ the children of the employee or any one or more of them; ▪ any other persons (or any one or more of them) being persons who in the opinion of the employer were dependent upon the employee at the date of the employee’s death; ▪ The legal personal representative of the employee.
