Payments from Construction Fund. In the Indenture, the Authority has authorized and directed the Trustee to make payments from the Construction Fund to pay the Cost of the Project upon receipt of Requisitions signed by an Authorized Company Representative, setting forth the matters required pursuant to Exhibit "B" to the Indenture.
Payments from Construction Fund. Except as otherwise provided in the last paragraph of Section 3.3 hereof and in Section 3.6 hereof, the Trustee shall make payments from the Construction Fund upon receipt of a requisition from an Authorized Company Representative, stating:
(a) The Costs to which the payment relates, and with respect to work and material, stating that such have been incorporated into the Project substantially in accordance with the plans and specifications therefor;
(b) The payee, which payee may be the Company in the case of work done by Company personnel and in the case of reimbursement for payments previously made by the Company for the Issuer's account (other than payments made by way of set-off of mutual claims between the Company and the payee) and which payee may be the Company with respect to amounts to be paid to the Rebate Fund pursuant to Section 3.5 of the Agreement;
(c) The amount of the payments to be made;
(d) That the payment is due, is a proper charge against the Construction Fund and has not been the subject of any previous withdrawal therefrom or from any other funds representing proceeds of bonds issued by the Issuer on the Company's behalf. Each requisition will be accompanied by a statement in reasonable detail listing the Costs to be paid to any contractors, materialmen or suppliers or the Costs incurred or advanced by the Company for which it is to be reimbursed. The Trustee shall retain copies or records of each requisition for the Issuer and shall not destroy such records without the prior consent of the Issuer, which consent will not be unreasonably withheld. The establishment of the Construction Fund shall be for the benefit of the Company, and, except during the continuance of an Event of Default hereunder, the Company may enforce payments therefrom upon compliance with the procedures set forth in this Section 3.4.

Payments from Construction Fund. Payment of the cost of the Project shall be made from the Construction Fund. All payments from the Construction Fund shall be subject to the provisions and restrictions set forth in this Article.
Payments from Construction Fund. Payment of the cost of Improvements or any other payment permitted pursuant to Section 401 shall be made from the Construction Fund as herein provided. Moneys in the Construction Fund shall be disbursed by check, voucher, order, draft, certificate or warrant signed by the Executive Director or by any officer or employee of the Authority designated by him for such purpose.”
Payments from Construction Fund. Payments shall be made by the Trustee from the Construction Fund to the Borrower or its order, as the case may be, upon receipt of the draw request attached to the Loan Agreement as EXHIBIT B (“Construction Fund Draw Request”), which may be submitted by fax or by email in a PDF format. All payments made from the Construction Fund shall be presumed by the Trustee to be made for the purposes certified in said Construction Fund Draw Request, and the Trustee shall not be required to see to the application of any payments made from the Construction Fund. None of the funds in the Construction Fund shall be used for any purposes other than the payment or reimbursement of Project Costs and, if authorized hereby and applicable, the payment of principal of, premium (if any) on and interest on the Bonds. The Trustee shall not be bound to make an investigation into the facts or matters stated in any Construction Fund Draw Request and any certificates, orders, and requests and other documents received by the Trustee, as required by the Loan Agreement as conditions precedent to the payment from the Construction Fund. The Trustee shall not be responsible for determining whether the funds on hand in the Construction Fund are sufficient to complete the Project. The Trustee shall not be responsible to collect lien waivers.
Payments from Construction Fund. Payment of the Cost of the Tollway shall be made from the Construction Fund. All payments from the Construction Fund shall be subject to the provisions and restrictions set forth in this Article, and the Authority covenants that it will not cause or permit to be paid from the Construction Fund any sums except in accordance with such provisions and restrictions. Also, payments and deposits shall be made from the Construction Fund as provided in Section 603. Section 404. Items of Cost. For the purpose of this Agreement the term "cost" when used with respect to any facility shall mean and include all costs related to such facility, and, without intending thereby to limit or restrict any such definition, shall include the following:
