Common use of Payments to Company Clause in Contracts

Payments to Company. Except as provided in Section 3 hereof, Company shall have no right or power to direct Trustee to return to Company or to divert to others any of the Trust assets before all payment of benefits have been made to Executive and his beneficiaries pursuant to the terms of the Agreement.

Payments to Company. Upon termination of the Trust in accordance with Article XIII, all assets remaining in the Trust shall be returned to Company.

Payments to Company. Except as provided in Section 3 hereof, Company shall have no right or power to direct Trustee to return to Company or to divert to others any of the Trust assets before all payment payments to or for the benefit of benefits Covered Individuals have been made to Executive and his beneficiaries pursuant to the terms of the Agreements and this Trust Agreement.

The Trustee shall be entitled to rely conclusively upon the Company’s written certification that all such payments have been made.
